This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of sri E.sRlNlvASA REDDY, Advocate for the pefitioner and the sri Jithender Rao Veeramalla, Additional Public Prosecutor on behalf of the Respondent No.1 and of Sri Mallu Rajasekhar Reddy, Advocate for the Respondent No.2, The Court made the following: COMMON ORDER THE HON'BLE SMT. JUSTICE TIRUMALA DEVI EADA l.A.Nos.3 and 4 of 2025 in/and CRIM INAL PETITION No.10445 o12025 COMMON ORDER This Criminal Petition is filed by the petitioner/accused under Section 528 of BNSS, 2023 seeking to quash the proceedings against him in S.C.No.390 of 2024 on the file of learned Special Sessions Judge for Fast Tracking the Cases relating to Atrocities against Women-cum- Xlll Additional District Judge, Ranga Reddy District at L.B.Nagar, for the offence punishable under Sections 376(2Xn) and 506 of the lPC.
2. lt is submitted by learned counsel appearing for the petitioner/accused as well as respondent No.2/de facfo complainant that during pendency of the present Criminal Petition, the parties have compromised the matter and accordingly, LA.Nos.3 and 4 of 2025 have been filed to record compromise between them and to compound the offences.

4. Perused the affidavits filed by the de facto complainant in l.A.Nos.3 and 4 of 2025 which disclose that she has willingly consented for compromise. Since the parties were willing to enter into compromrse, they were given a chance to setfle the matter by appearing along with their respective counsel before the High Court Legal Services Committee for the State of Telangana ylde orders dated 19.08.2025 passed by this Court. The Secretary, High Court Legal Services Committee shall identify the pa(ies and submil a report to that effect.

Pursuant to the above said direction issued by this Court, the parties along with their respective counsel have appeared before the High Court Legal Services Committee for the State of Telangana and the Secretary of the above said Authority identified the parties and submitted a report dated 29.08.2025 stating that the parties were identified and they have wilrfulry and without any coercion entered into compromise as per the terms of compromise.
6. ln view cf the above, l.A Nos.3 and 4 of 2025 are allowed. Consequently, the Criminal petition is allowed and the proceedlngs in'$€.No.390 ot 2024 on the file of learned Special Sessions Judge for Fast Tracking the Cases relating to Atrocities against Women_ ,*w' ,' .,''' ,,. 011. 2023 the 2nd respondent 'lodged a written complaint alleging that her distant relati'/e viz., Kona Vijaya Laxmi who is residing at Hasthinapuram, L.B. Nagar and she runs chit business and the 2nd respondent also joined in her chit for the past 10 years. It is alleged that all of sudden said Vijaya Laxmi filed I.P. due to financial problem and this context she qot acquaintance with one Gazzalla Shiva Reddy and he promised that he will settle the money matter with his sister and he used to contact her on phone and chit-chat with.her. It is alleged on 03-04- 2023 said Shiva Reddy contacted her on phone and told her that he has to meet her personally when she was in Bank and after completion of bank work she came out side and seated in his car and he took her to his guest house where he sexually participated with her.forcibly and he promised that he would loo!< after her family members and he participated sexual intercourse rnultiple times. It is alleged that on 14- 09-2023 he came to her house arid partlcipated. sexual intercourse. Hence she requested to take action. The Police registered a case in Crime No. 1111of 2023 under Sec. 376 (2) (n),506 IPC basing on the complaint. Later, the Police filed a charge sheet before the trial and the same was numbered as S.C.No. '390 of 2O24. It is respectfully submits that during the pendency of the proceedings, the w6I wishers and erders oF the both the famiry intervened and advised petitioner and 2nd respondent to setfle the disputes amicably to maintain harmony in their marital life and if the proceedings are continued it would leads to disturbance in their family life creating complications. Therefore they advised the parties to amicably settle the matter as the.dispute arose due to financial issues with regard to chit business. pursuani to the setflement, both the Petitioner and 2nd respondent have cJecided to put an end to the litigation and arrived at setflement and compromised their disputes. In pursuance of the settlement, the 2nd respondent/compla inanl agreed to withdraw the criminal case filed against the Petitioner/Accused as it was lodged due to said dispute It is submiited that 2nd respondent entered into compromise with the Petitioher:s/Accused -on .her own vorition ,and wir,r and consent. There is no coerce, force, any undue influence and collusion. In view of the facts and circumstances and in the right of settrement between the parties, if the proceldings in S.C.No. 390 of 2024 on the file of Special sessions Judge for Fast rracking the cases rerating to Atrocities against Women-cum-XIII Additional District Judge, Ranga Reddy District at L.B.
