2. W.A.No.B64 of 2O2S is iited aggrreved by the interim order, dared 29.07.2o2s passed in LA.No. 1 of 2o2s in W.P.No.22O99 ot 2025 and W.A.No.B65 ot_ 2O2S is filed aggrieved by the interim order, dated 22.07.2025 passed in I.A.No. 1 of 2O2S in W.p.No.2 t2Z9 of 2025 by the learned Single Judge.

Heard Sri Sriram polali, learned counsel appearing for the appellant-Institute and Sri K. prudvi Raj, learned counsel representing Sri Srinivasa Rao Bodd uluri, learned counsel appearing for the contesting respondents. 4, Learned counsel for the appeliant_ lnstitute had contended that the contesting respondents have challenged 2 G.O.Ms.No.107, d,ated 28.O7 '2023, beforc the learned Single Judge, u'hercin it deals rvith tl-re hike in annual tuition fee for non-minority / rn in orttY Medical and Dental Private unaided block Period 2023-2026. Learned counsel for the appellant had further contended that the respondent_Colleges had given an undertaking that the students would not be prevented lrom attending classes artd would not be compelled to deposit the differential amount of fees. Based upon such submissions, the aforesaid said order was passed by the Division Bench and the matter is pending respondents herein However, contesting co nsideration very same G.o., dated challenged the 28.07.2023 by fiting W.P.Nos.22099 and 21279 of 2O2S In the said Writ petitions i.e., W.P.Nos .22ogg & 21229 of 2025, the learned Single Judge was pleased to record the order, dated 03.04.2025 passed by the Division Bench in W.A.No.34 1 of 2025& batch, no*.u"" rnterim direction as prayed for was granted by the learned Singie Judge in favour of the contesting respondents. 6 Learned counsel for the appelrant had further contended that the interim direction sought by the contesting respondpts was for re_fund of the differential amount alreadv --1 4 collectecl by the appellant' Howc'rer , the learned Single Judge after recording the submissions of the Partres, had gralted praYed for' Hence' that portion of the interim direction as refund of the Single Judge, directtng order of the learned differential amount coliected from the contesting respondents' deserves to be set aside' as it is contrary to the earlier order passed by tl-re Division Bench oi this Court in W'A'No'34 1 of 2025 &, batch, dated 03'04 '2025' ln the eariier orCer ie W.A.No.341 ol 2C25 & batch' the respondent-colleges had givcn an undertaking that students would not be prevented from attending classes and would not be compelied to pay the differenrial fee and the appeilant herein had also furnished a similar r-indertaking' 'lherefore' to the extent it directed the refund of the differentiai amount is liable to be bet aside' I '
