This Petition coming on for hearing, upon perusing the Memorandum of Grounds of criminar Petition and upon hearing the arguments of sri Ayesha Saba, Advocate for the petitioner and the Sri M.Vivekananda Reddy, Assistant Public Prosecutor on behalf of the Respondent No .1 and of Sri c.Hari Preeth, Advocate for the Respondent No.2 The Court made the foilowing: COMMON ORDER HON'BLE SMT. JUSTICE JUWADI SRIDEVI l.A.Nos.1 and 2 of 2025 in/and CRIMINAL PETITION No.9236 of 2023 COMMON ORDER: This Criminal Petition is filed under Section 482 of Crp.C. by the petitioner/accused to quash the proceedings against him in C.C.No.1055 of 2022 in Crime No 707 of 2O2O of police Station, WPS, CCS, DD, Hyderabad on the file of Xllt Additional Chief Metropolitan Magistrate (Mahila Court) at Nampally, Hyderabad, registered for the offences punishable under Sections 4g4, 420 and 406 of lPC.

2. lt is submitted by learned counsel appearing for the petitioner as well as the respondent No.2, that during pendency of the present Criminal Petition, the parties have compromised the matter and accordingly, l.A.Nos.1 and 2 o'f 2025 have been filed to record the compromise between them and to compound the offences. 3 Vide order da\ed25.04 2025, this Court directed the parties along with their respective counsel to appear before the I I Secretary, High Court Legal Services Committee, High Court for the State of Telangana, Hyderabad, for identification and to submit a report. 2

Pursuant to the above said direction issued by this Court, the parties have appeared and the Secretary, High Court Legal Services Committee, has identified the parties and submitted a report, dated 10 06.2025 and the same is placed on record. ln view of the above, LA.Nos.l and 2 of 2025 are allowed. 5 Consequently, this Criminal Petition is allowed and the proceedings against the petitioner/accused in C.C.No 1055 of 2022 in Crime No 707 ot 2020 of Police Station, WPS, CCS, DD, Hyderabad on the file of Xlll Additional Chief lVletropolitan Magistrate (Mahila Court) at Nampally, Hyderabad, are hereby quashed Miscellaneous applications, if any pending, shall stand closed. Therea fter, the police upon completion of Investi gation, filed the chilrge sheet before the Hon,ble XIII Additiona I Chief Metropolitan Magistrate at Nampally, Hyderabad against the euash Petitioner herein for the offences U/s. 406 of IpC and the same was taken cognizance by the learned Magistrate for the offences mentioned above against the euash peti tioner/Accused and numbered the same as C.C.No.105 512022 and now the Case is pending on its file. It is submitted that the euash petitioner/Accused have already filed Crl.P.No.9236/2023 before this Hon,ble Court 494 420 i+)l'\'#' )--'' -q.- .1 \ - 4 against him in seeking to quash the Proceedings C.C.No.1055/2022 pending on the file of XIII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad and the same is ,ut pending.

2. it is submitted that pending the above-mentioned case, a Compromise have arrived at between parties to this Joint Memo at the intervention of family elders and well-wishers of both Families, who advised the pafties to this Joint Memo to settle the pending disputes amicably. It is further submitted that in pursuance of the Compromise, a Memorandum of Understanding/MOU was executed by reducing the terms and conditions in writing on 03-09-2024. It is further submitted that as per the terms of the MOU, the Quash Petitioner/Accused and the 2nd Respondent/Defacto-Complainant agreed to separate by obtaining Divorce mutually and also agreed that they should. close all the pending civil and criminal cases filed against each other by filing appropriate applications before the respective courts and the copy of the said MOU, Dt.03-09-2024 is filed herewith as Annexure to be made part and parcel of this Compromise. It is submitted that in view of. the above-mentioned 3. compromise, the pafties to this loint Memo have decided to separate themselves by obtaining Mutual Divorce to live peacefully to lead their respective Iives in the intei-est of their future as per the advice of elders and well-wishers of both Families and as such, the 2nd Respondent has no grievance against the Quash Petitioner/Husband and she has decided to with draw the Criminal Case filed by her in C.C.No.1055/2022 pending on the file of XIII Additional Chief Metropolltan Magistrate at Nampally, Hyderabad against the Quash tions before this Hon'ble sed by filing appropriate Peti Petitioner/Ac (-b (- I Court. Therefore, this Hon'ble court may record the Compromise in the interest of lustice by allowing the above'quash petition.

In view of the above-mentioned reasons and the compromise entered between the parties to this joint memo, both the parties would co-operate for the crosure of the above-mentioned case in 105512022 pending on the file of XIII Additional Chief Metropolitan Magistrate at Nampally, Hyderabad. It is therefore prayed that this Hon,ble court may be pleased to record the terms of compromise in Crl.p.No.9236/2023 and pass such other order or orders in the interest of justice.
