JUSTICE TIRUMALA DEVI EADA CRIMINAL PETITION NOS.10250 and 10262 of 2025 COMMON ORDER: These petitions are filed seeking quashment of the Crime No.730 of 2025 on the file of Jawaharnagar Police Station, Rachakonda District, against the petitioners.
2. Heard Ms.Challa Kiranmayee, learned counsel for petitioners and Mr.Jithender Rao Veeramalla, learned Additional Public Prosecutor appearing for the respondent No.1-State.
3. Learned counsel for the petitioners has submitted that there are civil disputes pending between the petitioners and respondent No.2. The complaint has been lodged only to harass the petitioners by implicating them in a criminal case. There is no truth in the allegations, and hence, prayed to quash the same.
4. On the other hand, learned Additional Public Prosecutor submitted that a notice under Section 35(3) of Bharatiya Nagarik \ Suraksha Sanhita, 2023 (for short 'BNSS'), has already been ibsued to the petitioners and that the intervention of this Court at this juncture is not essential. 2
5. Perused the record. The afiegations pertain to offences under s;ections 79, 3s1 (2) rlw.3 (5) of Bharatiya Nyaya sanhita, 2023 (lbr short 'BNS) and section 3 (1) (r) (s) (c) of rhe scheduled castes and rhe scheduled rribes (prevention of Atrocities) Act, 1989 (for short 'poA Act'). The copies of notice under $ection 35(3) of BNSS are enclosed in the case file. Therefore, it is not proper to intervene in the investigation process at this juncture.
