ORDER:
This CrLminal petition is filed under section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for granting ofpre_arrest bail to the petitioner/ accused in crime No.533 0f 2025 0f cheverla police station, cyberabad, registered for the offences punishable under sections s2e(3),324(41, 1i8(1), 11s(2), 3s2,3s1(2)..rlw 4e r/w 3(5) of the Bharatiya Nyaya Sanhita (for short ,BNS).
Heard Sri K.Vcnumadhav, learned counsel for petitioner and Sri Syed yasar Mamoon, learned Additional public prosecutor for respondent State ; tt,
Without going into the merits of the case, since the punishment prescribed for the offences alleged against petitioner is less than seven (07) years, this Court deems it appropriate to direct petitioner to appear before the Investigating officer on or before 29 .og.2o2s between 1 1 :00 a.m. and 05:00 p.m. and in turn, the Investigating Officer is directed to follow thc procedure laid down under Section 35(3) of the Bharatil,a Nagarik Suraksha Sanhita (previously, 41_A of Cr.P.C.) and also the guidelines formulated by the Honourable Suprerne Court of India in Arnesh Kumar u. 2 SKS,J Crl.P.No.1O23O of2O2S State of Bihar t scrupulously. However, petitioners shall submit his defense and co_operate with the Investigating Officer as and when required by furnishing information and produce all relevant documents/material required for the purpose of the investigation and the lnvestigating Officer shall consider the same before filing appropriate report before the learned Magistrate concerned.
