With their consent, this writ petition is being taken up for disposal at the admission stage itself.

The petitioner is aggrieved by the action of the rcsponc'lcnt No.3, Station House Officer, Saidabad Police Station, in interfering into civil dispute between the petitioner and the respondent No.4, l,andlord, by putting pressure on the petitioner to vacate the premises and sctik: the dispute with the respondent No.4 in respect of the property bearing H.No.16-1-26/29/ A, 3d floor, opposite Welcare l{ospital, Saidabad Colony, Hyderabad, (hereinafter referred to as'the subject premises'), and with a consequential prayer to direct the respondent No.3 not to irrterfere in civil dispute between the petitioner and the respondent No.4
3. The learned counsel for the petitioner would submit that the petitioner is a tenant of respondent No.4 since 21 years and is paying rent regularly. While so, from the last one year, the respondent No.4, Landlord, is insisting the petitioner either to enlrance the rent or to vacate the premises. Further, at the instigation of the respondent No.4, accused \ \ 2 persons sh;rik shafi and Altal who are having criminal record, are harassing the petitioner to vacate the said prernises or else they will kill the petitioner and his family. It is further submitted tl-rat on 03.0g.2025, when the petitionerr along with his family went outsicle by locking the door, the saicl accuse<l persons, arong with five others, entered into house by breaking the lock, damaged the furniture ancr stolen 5 thuras of gord and Rs.4,500/- cash and on seeing and questioning the same, the said accused persolls attar:ked on the petiti<lner and beat the petitioner mercilessly. whcn thc saure was reported to the police, police did not register any case against the said accused more so, pressu rizing the petitioner to settle the dispute with the accused and vacate the subject prernises. 4' l[ is further submitted that the petitiorie.r filecl a suit for perpetual inju.ciio. ag,ainst tr-re respcrrderrt f,ro.4 before the city Civil Court, H};d<'raoad, rarft16i1 is under scrutiny. at the instigation of the responcient No''l' I)oiicc are builciing Pressure on the petitioner to vacate the subject premises else they will implicate in false criminal cases. Due to the harassrnent b1r 1fis police, the petitioner is suffcring from mentar torture and ag,ony. Q,estioning the same, the present writ petition is filed. 5' on the other hand, the learned Assistant Government pleader for Home placed a copy of the instructions dated 12.0g.202s, wherein it is subrnittec{ that the petitioner lodged a complaint with the respondent Nio.3 o.03.08.2025 vvith regard to subject matter. Based on the said complaint, J Police made petition entry and after visiting the subject premises causing enquiry, which is under progress and after finalization of the enquiry, necessary action will be taken as per law. Except causing an enquiry in to the complaint lodged by the petitioner, the respondent No.3 ncither \ \\ interfered with the civil dispute nor pressurized the petitioner to vacate the premises and to settle the dispute with the respondent No.4. Further, the respondent No.3 and staff are discharging their legitimate duties and are not harassing the petitioner to settle the civil dispute with the respondent No.4 nor taken any coercive steps against the petitiont:r in any manner. Hence, prayed to dismiss the writ petition. \
6. On a perusal of the contents of the material made availabie on the I t t ] record, it appears thaL t-h-e1g..is a tenancy dispute between thc petitioner and the respondent No.4. [t is categorically subrnitted by the funec{ .,1.,, Assistant Government Pleader for Home that based on the conrplaint lodged by the petitioner, the respondent No-3 is causing an enquirv into the matter and t'tre Police are not'interfering with the civil dispute.

In that view of the matter, recording the said submissions that the respondent No.3 is causing an enquiry into the complaint lodged by the petitioner and the Police are not interfering with the civil dispute, anc'l that the petitioner has filed suit and pursuing his remedy, the writ petition is devoid of merits, fails and is liable to be dismissed 8' Accordingly, this writ petition is dismissed.
