This Writ Petition is hled undcr Article 226 of the Constitution of India, seeking the following relief "...to lssue an order or direction more particularly one in the nature of Writ of Mandamus to declare the action of the respondents in not implementing the minimum time scale attached to the post hold by the petitioners, as per the judgment of the Apex court in the case of State of Punjab Vs. Jagjit Singh and others in Ciuil Appeal No.213 of 2013, dt. 26-10-2016, as highlg illegal, iregular, unconstitutional against the principles of natural justice, equity and foir plag and praAs to direct tLe respondents herein to pay the salaries of the petitioners according to the new PRC scales and arrears from the date of their eligibilitg . . . "

3. Heard Sri Gurram Srinivas, learned counsel for the petitioners; learned Government Pleader lor Services-l for respondent Nos.1 and 3 to 7; and learncd Government Pleader for Services-lll for respondent No.2

Learned counsel for the petitioners submits that the petitioners are working as Pharmacists and Lab Technicians on outsourcing basis and they are eligible and entitled to receive Minimum Time Scale of pay attached to their respective posts in 2 i,ii..' .. r) ;,irr tLl-t.l - view of tire principle laid dou.n by the Hon'ble Apt:x Court in State oJ Punjab v. Jagjit Singh and othersl, u'hereir-r it w'as held that an employee engaged for the same work cannot be paid less than another employee, who perform the silrne duties and responsibilities. As such, the petitioners macle a representation to the respondents on 21.12.2023 requesting to grant Minimum Time Scale of pay as per Jaglit Singh's case (referred supra). However, no action has been taken by the respondents so far. Therefore, learned counsel prays this Court to direct the respondents to consider the representation, dated 2l .12.2023. submitted by the petitioners and pass appropriate orders, within a stipulated period of time.

5. Learned Government Pleader for the respondents submits that the respondents will consider thc re prt:sentation of the petitioners, d.ated 21.12.2023, and pass appr()priate orders, jn accordarce with law.

Having regard to the submissions made b1. lcarned counsel for the reSpective parties, this Writ Petition is disposed of, directing the respondents to consider the representation, dated 21.12.2023, submitted by the petitioners duly taking into consideration the principles laid down by the Hon'ble Apex Courl in Jagjit Singh's I 2017 (tl SCC 148 I \ To, J PK.J 1l,1) 2.10q7 2o.t5 case (relerred supra) and pass appropriate orders, strictly in accordance with law, as expeditiously as possible, preferably within a period of six (6) weeks from the date of receipt of a copy of this order and communicate a copy thereof to the petitioners.
