The Court made tl^e following: COMMON ORDER THE HON'BLE SMT. JUSTICE TIRUMALA DEVI EADA l.A.Nos.2 and 3 of 2025 in/and CRIMINAL PETITION No.10177 ot 2025 COMMON ORDER: 1. This Criminal Petition is filed by the petitioner/accused No.2 under Section 528 of BNSS, 2023 seeking to quash the proceedings against her in C.C.No.5578 of 2023 on the file of learned Xlll Additional Chief Metropolitan Magistrate, Hyderabad, for the offences punishable under Sections 3'l 3, 498-4 of l.P.C. and Section 5 of the Medical Termination of Pregnancy Act, 1971 .
2. lt is submitted by learned counsel appearing for the petitioner/accused No.2 as well as respondent No.2lde facto complainant that during pendency of the present Criminal Petition, the parties have compromised the matter and accordingily, l.A.Nos-2 t and 3 of 2025 have been filed to record compromise between them and to compound the offences.
3. The learned Assistant Public Prosecutor has opposed the said compromise petitions.
4. Perused the affidavits filed by the de facfo complainant in l.A.Nos.2 and 3 of 2025 which disclose that he has willingly ., consented lbr compromise. Since the parties were willing to enter into comprcmise, they were given a chance to settle the matter by appearing along with their respective counsel beforr: the High Court Legal Servi:es Committee for the State of Telangana ylde orders dated 12.08.2025 passed by this Court. The Secretary, High Court Legal Servi:es Committee shall identify the parties and submit a report to that effect.
5. Pursuant to the above said direction issued by this Court, the parties alonly with their respective counsel have appeared before the High Court [.egal Services Committee for the State of Telangana and the Secretary of the above said Authority identified the parties and submitted a report dated '19.08.2025 stating that the parties were identified ard they have willfully and without any cobrcion entered into comprornise as per the terms of compromise.
6. ln vie'rv of the above, l.A.Nos.2 and 3 of 2025 are allowed. Consequenty, the Criminal Petition is allowed and the proceedings in C.C.No.5li79 of 2023 on the file of learned Xlll Additionat Chief Metropolitan Magistrate, Hyderabad against the petitioner/accused No.2 are hereby quashed subject to the petitioner/accused No.2 paying an arnount of Rs.5,000/- (Rupees Five Thous;rnd Only) to the 3 Director, Sainik Welfare, Hyderabad (Savings tuc.No.52188926279, State Bank of lndia, Shantinagar Branch (20070), IFSC Code:SBlN002OO7O, MICR No.500004057) and Rs.5,000/- (Rupees Five Thousand Only) to the High Court Legal Services Committee for the State of Telangana, within a period of two (02) weeks from today and file proof of the same before the Registry. 7 Miscellaneous applications, if any pending, shall stand closed.
