WRIT PETITION No. 23310 of 2025 ORDER: This Writ Petition is filed, aggrieved by the prohibitory orcier dated 11.O2.2025 issued by the 4rh respondent, directing the Sth rcspondent bank to recover and transfer a sum of Rs. 10,29,460/, including interest, from the petitioner,s bank accounts fowards alleged arrears under the ESI Act, 1948, read rvith Rule 5 of the Second Schedule of the Income Tax Act, 196 1.
2. Heard Sri Mohd Ghulam Rasool, learned counsel for petiLioner, and Sri A_ I(rarthi Kumar Reddy, learned Standing Counsel for the Central GovernmenL for respondent No.1. perused the record. 3 . Le arned counsel for petitioner submits that the ESI cr.,ntriburions are being regularly arr d duly paid under Sub Code No.7 1520494530011019, while the Main Code No.5200049453000 1O19 has remained inactive since 2019 due to closure of operations. As a result of the impugned order datecl 11.O2.2025, the petitioner's three bank accounts have been frozert, causing serious financial hardship and obstmcting receipt of Rs. 1,97,96,995/ payable to petitioner by trlectro Steel Casting / / l J 2 Ltd. It is further stated that petitioner har; already paid Rs.5,a3,9f 1/- t-hrough auto-debit, deniald draft, lrrd post.dated cheques; thereforc, the attempt to recover the fu t amount again constitutes double recoverv, which is rvholl . iliegai and unjustified. The freezing of accounts has not o: [v affected the petitioner's business operations but also violates 1l e fundamental right to propertv under Article 300A of the Constitu ion. Lcarned Standing counsel for trSI Corporation further refers to Sections 74 and 75 of the trSI Act, which reads as follows: Section 74 of the ESI Act reads: Conslitution oI Umployees Insurance courL: (l) Th. Having considered the respective submissions and perused thc rccord, the allegations with regard to payments already made. and double charging despite closure of Main Code No. 52000494530001019, are questions of fact that this Court is not ( I t I 4 inclined to go into in a *,rit petition. In view of Scc Lions 74 and zS of the ESI Act, and also in the light of the juclr ment in Ashok Legland (supra), this Court is of the considereri ,pinion that the remedy before the tr,SI Court is appropriate to adj urdicate the question of fact rvith regard to alleged contributro rs/pavmcnts in this matter.
