Petition Under Section 151 cpc praying that in the circumstances stated in the affidavit fired in support of the petition, the High court may be preased to direct the respondent No.5 to folow the direction of the Hon,bre Apex court Lalitha Kumari Vs State of Utter pradesh, and to take the necessary action against the respondent Nos.6 and 7, who trespassed into the house of the petitioner and thefted the gold ornaments, there upon by questioning the petitioner, they deveroped the grudge against the petitioner and created the panic situation and threatened with dire consequences, by registering the criminar case against the respondent Nos.6 and 7 pending disposal of the writ petition. 2. According to the petitioner, respondent Nos.6 and 7 attended Birthday Function on 11.05.2025, and on 13.05.2025 they have committed theft of gold. Therefore, the petitioner has sent a complaint dated I1.06.2025 to respondent No.5 with a request to take action against respondent Nos.6 and 7. Despite receiving and acknowledging the said complaint, respondent No.5 did not act upon the same. Challenging the said inaction of respondent No.5, the petitioners filed thc present writ pctition
3. Whereas, leamed Assistant Govemment Pleader for Home, on instructions, would submit that respondent No.5 has received the said complaint through registered post with acknowledgment due on
26.06.2025. The petitioner did not mention the phone number on the said complaint. She has to go to thc police station, submit signed t 2 KL.J W.P No.2-] l5'l of 2025 I report to respondent No.5, then respondent No.5 will considcr the complaint and take action/investigate strictly in accordance u,ith the procedure laid down under the BNSS.
4. As discussed above, even according to thc petitioner, respondent Nos.6 and 7 came to the house of Smt. G. lakshmi, her relative's house, to attend her grandson birthday. Respondent Nos.6 and 7 are also relatives to the petitioncr. Suspecting that respondent Nos.6 and 7 committed theft of gold on 13.05.2025, the petitioner has sent the complaint initially on 1 1.06.2025 through regisrcred post with acknowledgment due. Thus, there is delay of almost one month. There is no explanation, much less plausible explanation lrom the petitioner for the said delay. Instead of approaching respondent No.5 pcrsonally on 13 .05.2025 or immediately thereafter she has sent the said complaint through registered post with acknowledgment due. She has filed the present writ petition only on 04.08.2025. For the said delay also, there is no explanation lrom the petitioner. However, it is for respondent No.5 to consider thc said aspects rvhile conducting enquiry.
5. In the light of rhe abovc. this writ petirion is disposed of dirccting the respondents to consider the complaint dated I 1.06.2025. l Kt-,J lV P. No 21151 of2025 also aforesaid aspects and take action strictly in accordance with the procedure laid down under BNSS. In the circumstances of the case, there shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition shall stand closed. SD/.A.
