ORDER:
This Writ Petition is fited seeking a Writ of Mandamus declaring the inaction on the part of the respondent authorities on the representationofthepetitionerdatedll.oT.2oz5regardingtheillegal and unauthorized construction underlaken by respondent No.5 by encroaching pubtic road as illegal and arbitrary and consequently to directtherespondentauthoritiestolorthwithdemolislrtlieillegal construction made by respondent No'5 and to pass such other order or orders.
Learned counsel for the petitioner submitted that respondent No.5, who is the petitioner's neighbour, has constructed a house in an agricultural land in Sy.No.112 situated at Lingogithanda X Road' Utnoor Mandal, Adilabad District, by encroaching upon the public road and without obtaining any valid permission from the respondent authorities. Leamed counsel for the petitioner further submitted that the petitioner has submitted a written representation to the respondent authorities on 11.07.2025, but no action has been taken against I t 2 wp_23747 respondenl No.5 till date. Aggrieved by the inaction of the respondent authorities, the present Writ petition is filed.
Sri K. Pradeep Reddy, leamed Standing Ccunsel for Gram Panchayat, appearing for respondent No.4, has forrvarded a copy ol the building permission granted in favour of responde, nt No.5.
ln vierv of the same, this Courl finds that the grievance of the petitioner that there is no house building permission in faovur of r-espondent No.5 is not sustainable. With regard to the grievance that there is cncroachment of the pubtic road by respondent No.5. on perusal of the photographs liled by the petitioner along with the writ affidavit, there does not appear to be any encroachment. In view thereof, this Writ petition is closed with liberty to :.he petitioner to make an appropriate application to the respondent ar-rthorities if there is any encroachrnent of the public road as clairned. .l.here shall be no order as to crlsts.
