4. The petitioner in W.P.No.6697 of 2024 ts the unofficial respondent in W.P.No.23737 of 2024 and unofficial respondents in W.P.No.6697 of 2024 are the petitioners in W.P.No.23737 of 2024.

5. For the sake of convenience, W.P.No.6697 ol 2024 is taken up as leading case to decide the lis in these cases.

It is stated that the petitioner is the owner and possessor of the' agricultural land admeasuring Ac.O.26 gts., in Sy.No.2/a, Ac.0.29 gts., in Sy.No.58/a, Ac.0.33 gts., in Sy.No.64la, Ac.0.03 gts., in Sy.No.65/a, Ac.O.26 gts., in Sy.No.68/a, total admeasuring Ac.2.37 gts., situated at Palata Village, Manoharabad Mandal, Medak District, having succeeded the same through Will Deed, datcd 04 O1.2Oi2, executed by her late mother and the revenue authorities have recorded her name in the revenue records and also issued pattadar passbooks and titie deeds in her favour in respect of the subject property. it is further stated that the petitioner has filed an appeal under Section 5 of the Telangana Rights in Land and Pattadar Passbooks Act, \971 (for short "the ROR Act, 1971") before respondent No.3, aggrieved by the mutation proceedings issued by respondent No.4 uide proceedings No.B/3581/2013' Respondent No.3, by an order, dated 05.O7.2016, disposed of the same observing that the subject matter under appeal is pending before the VI Additional District Judge, Siddipet in A.S.No.26 of.20lL and as such I ::3:: interlerence at this stage is not correct as the subject rnatter of the appeal is sub .judiced before the civil Court. Aggrieved by the same, the petitioner filed a revision application under Section 9 of the RoR Act, 197 l before respondent No.2. By an order, dated 0g.02.202 1 in Case No. spl.Tribunar/ F3l sg8/2o2r respo,dent No.2 had dismissed the revision petition and thc partics are advised to agitate their grievances in pending case before the civil Court. It is further stated that during the iife time of the petitioner,s 7 ' mother, she had instituted a sult uid.e o.s.No.62 of 2ooz on the 1ire of the Senior Civil Judge, Siddipet, seeking declaration and consequential injunction on the very same subject property and the said Court has disrnissed the suit uide judgment arrd decree dated 09.06.2011 . A counter claim filed by defendant No. 1 seeking for cancellation of sale deeds was also rejected. It is Iurther stated that questioning the said judgment and decree dated 09.06.201 1, the pctitioncr filecl first Appeal vide A.S.No.2 3 of 2022 on the file of the I Additional District and Sessions Judge, Medak and the same was also dismissed uide judgment, dated 13.Og,2023 confirming the judgment and decree dated 09.06.20I 1 passed in O.S.No.62 of 2OO7. Thereafter, the petitioner and the unoificiar respondents herein have made an application for correction of the revenue entries and consequential issuance of the pattadar passbooks. The applications "l frled by t}le petitioner as well as the unofficial respondents have been dismissed on the ground of pendency of the civil suit as well as first appeal. While dismissing the appeal filed by the petitioner' the appellate authority has given a finding that the subject matter of the appeal is sub judiced before the civil Court'

8. Considered the submissions of the learned counsel for the respective parti€'s and rvith their consent' this u-rit petilr{)n is being disposed of at the admission stage' g. Sri J. Prabhakar, learned Senior Counsel appearing for the unofficial respondents has submitted that pending adjudication of the first appeal fiied by the petitioner, they have also filed an appiication seeking mutation of their names in respect of the subject lands in the revenue records and the said application has been rejected on the ground of pendency of the suit and first appeal'

10. Leamed counsel appearing for the parties has fairly submitted that pending adjudication of the writ petition' appeal instituted by the petitioner against the Judgment and Decree in O S No 23 oi 2007 has been dismissed

The above said facts and also lhe fact s'ith regard Lo the applications filed bv either of the parties seeking for mutation of their names in the revenue records have not been brought to the notice of ,r .. :!!!!lr! 5 the special Tribunal. since the fact of disposa.l of the appeal suit filed against the judgment and decree in O.S.No.62 of 2OOZ and the rejection of the applications for mutntiorr of their names in the revenue records arrd the counter claim made by the motl_rer of the petitioner have not been brought to the notice of the Appellate Authority, thc Appellate Authority has dismissed the craim of the petitioner. 12, In the said circumstances, this Court deems it appropriate to set aside thc impugned orders passed by respondent No.2 in both the writ petitions i.e,, Case No. Spl.Tribunal/ F3 / Sg8/2021, Case No.F3/848/201,7, dated OB.O2.2O2| and the proceedings Proc.No.D 1 /2 02 / 2024, dated, nil-O7.2024.

Accordingiy, both the writ petitions are disposed of relegating the. petitioners to Ille fresh apprications seeking for mutation of their names in the revenue records in respect of the subject property ald on such applications being filed by the parties, the District Collector is directed to conduct enquiry after issuing notice to the parties. After conducting enquiry, taking into consideration the documents fi1ed by the petitioners as well as the respondents and their entitlement for mutation of names in the revenue records and findings arrived by the trral Court in O.S.No.62 of 2OO4 with regard to entitlement of the respective parties for mutation of their names in the revenue records I j 6 in respect of the subject property, the District Collector is directed to pass appropriate orcicrs lor issuance of pattadar passbooks in accordance with law. If the parties are not othervrise entitled' pass appropriate reasoned orCer and communicate the same to the parties. The entire exercise shall be completed within a period of eight (08) weeks from the date of receipt of a copy of this order.
