Aggrieved by the action of r spondent No.4 in refusing to receive and register memor dum of deposit of title deeds in respect of petitioner,s ouse No. 42-397/1 (PTIN No.1151801981), 1n Sy.No.348 1 admeasuring 8O.0 Sq. Yards, situated at Anjaiah Nagar, Quthbullapur Village and Mandal, under GHMC euthb llapur circle, Medchal- Malkajgiri District, the petition r filed the present writ petition.

Learned Assistant Govern ent Pleader for Stamps and Registration submits that without presenting the subject document, the petitioner as approached this Court seeking registraticn of the said d ument. If the petitioner 2 presents the same before the Registering authority, the respondents will receive the same and iollour the procedure as contemplated under Section 71 of the Registration Act, 19O8 (for short, the Act, 1908J.

Section 71 of the Act, 19Og, reads as foilows: Reasons for refusal to register to be rccordcd.- ( 1) Every Sub-Registrar refusing to rcgister a document, except on the ground that the property to which it relates is not situated rvithin his sub- district shali make an order of refusal zrnd recorded his reasons fbr such order in his Book No.2, ancl endorse the words "registration rcfused', on the document; and, on application made b1, any person executing or claiming under the document, shall, without payment and unnecessary dela1,, give him a copy of the reasons so recorded. (2) No registering officer shall abcept for registration a dcicument so endorsed unless and until, r-rnder the provisions hereinafter contained, Lhc clocument is directed to be registered.

In view of the aforesaid submissions coupled with the provision under Section T). of the Act, i9Og, this writ petition is disposed of directing the Registering Authority to receive, register and release the subject document that may j be presented by the petitione in respect of the subject property, subject to the peti oner complying with the provisions of the Act, 1908 as w 11 as the Indian Stamp Act,

1899. It will be open to the Re stering Authority to refuse the document presented before im, if he has any objection, by duly assigning reasons rn s pport of such decision and communicate the said decision o the petitioner. It is made clear that this Court has not expressed any opinion on merits of the case as to the ent tlement of the petitioner to get the subject document regi tered. There shall be no order as to costs
