Prabhakara Rao Dated: 10.08.2006 Per G.S.SINGHVI, CJ In this petition, the petitioners have prayed for quashing message F.M.No.634/SEC-B2/2006 dated 11.07.2006 and notification dated 08.07.2006 issued by Mandal Parishad Development Officer for clubbing the hamlets of Thumbur Village with Nainar Kandriga Gram Panchayat and the hamlets of Nainar Kandriga Village with Thumbur Gram Panchayat for the purpose of Gram Panchayat elections, 2006 without re-arranging and re- publishing the electoral rolls in terms of G.O.Ms.No.232, P.R. dated 30.05.2006 as per Section 12 of the Andhra Pradesh Panchayat Raj Act, 1994 (for short ‘the Act’). 06.08.2006, no person had filed nomination for the office of Sarpanch or Ward Members. Learned Government Pleader for Panchayat Raj and Shri V.V. Prabhakara Rao, learned Standing Counsel for State Election Commission, Andhra Pradesh say that election shall now be held after re-arranging and re-publishing the electoral rolls, keeping in view G.O.Ms.No.232 P.R. dated 30.05.2006 issued under Section 12 of the Act. In view of the statement made by learned Government Pleader and learned Standing Counsel for State Election Commission and averments contained in paragraph 8 of the counter-affidavit filed on behalf of State Election Commission, the writ petition is disposed of as infructuous. As a sequel to disposal of the writ petition as infructuous, W.P.M.P.No.18291 of 2006 filed by the petitioners for interim relief is also disposed of as infructuous.
