Judgment
Petitioner approaches this Court invoking the provisions under Section 482 of Cr.P.C. seeking to quash the proceedings against him in P.R.C.No.25 of 2011 on the file of the II Additional Judicial Magistrate of First Class at Eluru, West Godavari District, whereby he is facing charge for the offence punishable under Sections 3(1)(X) of the Scheduled Castes and Scheduled Tribes(Prevention of Atrocities) Act and 506 of IPC.
Heard both sides.
The case registered on 25.09.2010. After completion of investigation, police filed charge sheet and the same is numbered as P.R.C.25 of 2011. In the said charge sheet, it is stated that the petitioner is absconding. Whereas, learned counsel for the petitioner submitted that the petitioner is available. But the police never choose to arrest the petitioner and further submitted that the petitioner is ready to face the trial.
Considering the facts and circumstances of the case, if any warrant is pending, the petitioner is hereby directed to surrender before the II Additional Judicial Magistrate of First Class, Eluru, West Godavari District, in P.R.C.25 of 2011. On such surrender, the petitioner is directed to file an application to recall the warrant and the learned Magistrate is directed to recall the same on the same day on petitioner’s executing a personal bond for a sum of Rs.5,000/-(Rupees five thousand only) with one surety for the like sum.
