Learned counsel for the petltloners subrnitted ttrat the petitioners have not committed any offence and they were falsely irnplicated in the present crirne' Even according to the allegations rnade in the cornplaint and in the charge sheet, the ingred'ients of Sections 463 ' 464 ' 2 -r-_ 46a, 42O, 5Cr6 r/w 34 of IpC and Section 156(3) of Cr.p.C. are not attracted against the petitioners and entire a-llegations levelled against the petitioners are pureiy civil in nature. Hence, the initiation of the proceedings against the petitioners is a clear abuse of the process of law and the same is liable to be quashed.

4. per contra, respondent No.2 learned counsel appearing on behalf of submitted that the grounds raised by the petitioners have to be adjudicated after a full_fledged trial only There are no grounds to seek quashing of the proceedings, especially since in this case the evidence of pWs. I to 4 has already been completed and the learned Magistrate has issued summons to LWs.6 to 10. At this juncture, the petitioners cannot seek quashing of the proceedings.

5. The very sarne grounds were reiterated by the learned Assistant public prosecutor.

6. Learned counsel for the petitioners by way of reply subrnitted that petitioners, presence before the triai co.. rt may be dispensed with.
