Petition under Article 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to an appropriate Writ, Order, or Direction, more particularly a Writ of Mandamus, dectaring the action of the respondents in not providing the police protection even after the order is in existence vide E.A. KUMAR Writ Petition No.25856 of 2025 This rvrit petition is filed seeking the following prayer: "...declaring the action of the respondents in not prouiding the police protection euen after the order is in existerrce uide E.A.No.18/2022 in E.P.I{o.)8/ 2011 in O S I[o 207/ 2007 on the ftle of Juntor Ciuil Judge Huzurnq.gar informing to tlrc petitioner that dispute is ciuil in nature as illegal arbitrary unjust and uiolatiue of the Constitution of India and consequently to direct the offtcial respondents to prouide police protection to the petitioner and to hls land from the unofficial respondents..."
2. Heard learned counsel for the petitioner and lea-rned Assistant Government Pleader for Home appearing on behalf of respondent Nos.1 to 6. With their consent, this r,vrit petition is taken trp for disposal. Notice to respondent Nos.7 to 9 is dispensed u,ith.

The facts of the case in brief are that petitioner claims to be the absolute owner and possessor of the agricultural land admeasuring Ac.O-20 Bts., S_v.i\c.55A lAA3 and Ac.0-08 gts., in S1'.Ncr.5-50/AAB situated at Vellidhai:dcr Villagc, Garidepaili Marrclal, 1n Suryapet l)istrict, Telangana rvhich is reflected in patta 2 passbooks. while so, one Mr.Bellamkonda Radha Krishna and tu'<l others are trying to interfere with the petitioner,s peaceful possession. Accordingly, petitioner filed suit on the above said persons uide o.s.No.2or /2007 on the file of Junior civil Judge, Huzurnagar restraining the unlawful interference. Thereafter, the trial court passed the decree in favour- of petitioner, directing respondents therein not to interfere in the petitioner's land. Upon the continued interference, petitioner filed E.A.No. lB/2022 E.P.No.S 2O11 in O.S.No.2OZ /2OOT. As such, the Court ordered police protection r,vhich was conveyed to the concernecl Police Station. It is further submitted that even after the court passed orders for police protection and the petitioner despite making several representertion to the official respondents, no effective protection has been ensured. ()uestioning the same, the present writ petition is filed.

Ttre Sub-lnspector of Police, Garidepally police Station, suryapet District has placed a copy of instructions through leerrned Assistant Government pleader for Home w'herein the allegations made by the petitioner \\/ere denied J and it is submitted that as per the orders of trial Court, respondent No.6 along with concerned revenue authorities have visited the subject land and provided police protection on 07.ll.2023.It is further submitted that on 15.O7.2025, the petitioner lodged complaint with respondent No.6 rvith regard to subject matter and during the course of enquiry, it is revealed that since 2011, there are civil disputes pending between petitioner and unofficial respondents and others, as such the respondent/Police closed the complaint as 'civil in natttre' on 05.08.2025 and suggested the petitioner to approach the competent civil Court. The same has also been informed to the petitioner by post.

Per contra, learned counsel for the petitioner submits that petitioner has made a representation to Sub- lnspector of Police, Garidepally Police Station on O9.O7.2O25 narrating all the facts and also stated that respondent Nos.7 to 9 tried to kiIl the petitioner and also threatened to kill the Surveyor and Court Commissioner. It is submitted that respondent/ Police ought to have continued providing Police protection in view of orders of trial Court. 4

In that view of the matter, since the trial Court has already passed orders for police protection in E.A.No.18/2022 in E.P.No.OB/2}ll in O.S.No.2OT /2OOT, this writ petition is disposed of with a direction to respondent/ Police to re-consider the comltlaint of the petitioner dated 09.o7.2025 and reminder cornplaint dated
15.o7.20125 and provide police protection whenever there is a need and necessity and as and when petitionen requests for the same.
