Counsel for the Petitioner: SRI RAMU MANGALAMPALLY Counsel forthe Respondent Nos.1 & 2: Ms. B.LAXMI PRASUNA, SC FOR CENTRAL GOVT Counsel for the Respondent No.3: GP FOR HOME Gounsel forthe Respondent Nos.4 & 5: - The Court made the following: ORDER THE HON'BLE SRI JUSTICE ITAGESH BHEEMAPAKA WRTT PETITTON N .22669 of 2025 ORDER: The petitioner submitted an Online Application (No.FIY2077440794925 dated 07.03.2025) for renewal of his Passport (No.N3061854), however, the respondelt-passport authority has refused to renew his passport on the ground that the police verification revealed a pending criminal case against him in C.p.No.12346 of 2020 on the file of XII Additional Chief Metropolitan Magistrate, at Nampally, Hyderabad.
2. Heard Mr. Ramu Mangalampally, leamed counsel for the petitioner; and learned Standing Counsel for the Central Government. Perused the record. Learned counsel for the petitioner submits that this Court in a similar
3. matter in W.P.No.35056 of 2023 passed orders, stipulating certain conditions for renewal of the passport, and similar orders may be passed in this writ petition as wel[. r Learned Standing Counsel does r[ot dispute the submissions of the

Having considered the respective submissions and perused the record, including the Order dated 02.01.2024 p{ssed by a coordinate Bench of this I I Court in W.P.No.35056 of 2023, the respondent No.2 is directed to consider the Online Apptication filed by the petitioner for renewal of his Passport No.N3061854, on the following conditions:- i) The petitioner herein shall su$mit an undertaking along with an affidavit in C.C.No,'12346 of 2020, pending on the file of Xll Additional Chief Metropolitan Magrstrate, at NamPally, Hyderabad, stating that he shall not leave lndia during pendency of the said C.C., without permission 'l ofthe Court and that he shall cooperate with trial Court in concluding the proceedings in the said C.C.; ii) On filing such an undertaking as well as affidavrt, the trial Court shall issue a certified copy of the same within two (2) we,:ks lherefrom; iii) The petitioner herein shall submit an applicatirn afresh along with certified copy of this order as well as the aforesatd undertakrng before the Passport Officer / Authority concerned for rene rval of passport; iv) On filing such an application, the Passport Otficer / Authority shall consider the same afresh in the light of the observations made by this Court herein as well as the contents of the underterkirg given by the petitioner for renewal of passport, in accordance with l;rw, within three (03) weeks from the date of said application; v) Respondent No.2 shall consider Rule 12 of the Passport Rules, 1967 while considering the aforesaid applicatior s rbmitted by the petitioner; vi) On renewal of the Passport, the petitioner h€rretn shall deposit the same before the trial Court in C.C.No.12346 of 202C pending on the file of Xll Additional Chief Metropolitan Magistrate, at Nampally, Hyderabad; and vii) However, liberty is granted to the petitione' herein to file an application before the leaned Magistrate seeking permission to travel abroad, and it is for the learned Magistrate to consider the same in accordance with law.
