The sole ground of challenge in these \Writ Petitions' in relation to the procedure of application for admission to I,tsBS/BDS course for the academic year 2025-26' is based upon Section 4 of the Telangana Scheduled Castes (Rationalisation of Resewations) Lct,2O25 (for short 'the Act of ZOZ5), notified on 1'4.04'2025, whereby it has been made clear that the provisions of the Act of 2025 shall not be made applicable to the notificatiors/advertisements' which have dy been issued and not finalized for appointments in ^kr public service or admission into educational institutions' prior to the commencement of the Act'

According to the petitioners, advertisement for National Eligibility -cum- Entrance Test (UG) 2025 (for short 'NEET examination) was issued onOT '02'2025' at which point of time' there was no sub-classification of the Schedule C-aste category vrhich has been subsequent$ done by Gazette Notification ') 3 dated 14.04.2025, which operates prospectively. Accord.ing to the petitioners, online application form required to be submined in terms of the notification dated. 15.01.2025 for admission to lvtsBS/BDS course for the academic year 2025_ 25, prescribes for option of Scheduled Gste 1, 2 and 3 sub_ caregories as per notification dated 14.04.2025. The notification for holding NEET examination uide advenisement dated 02.02.2025 dtd require exercise of option as Scheduled Gste candidate only and not under any of the sub_categories brought into effect from 14.04.2025, by Act of 2025. The admission process to MBBS/BDS course has started from 07.02.2025 by issuance of notification for holding NEET examination. The provisions of sectio n 4 of the Act of 2oz5 are being applied rerrospectiyely, which has prevented the petitioners to exercise their option in the SC category, under which they had applied and participated in the NEET \ 4 a examination. Therefore' Petitioners have preferted these tffrit Petitions.

Detailed cowrter-affidavit has been filed by the Univeniry. 5 Learned Standing Counsel for the Universiry does not ute that the Act of ZO25 oPerates prosPecdvely to appointments in public sewice or admission in educational irstitutions. The process for admission to the medical institutions in rhe State of Telangana has commenced frcm 15.07.2025 upon issuance of the notification of the same date under the competent authoriry quota for the academic year 2075-26. It is further submimed that participation in the NEET examinarion, r,hich is an eligibility test, iPil f4ct0' does not amount to admission into the MBBS/BDS course for the curent War. It is submfued that notification dated t5-07.2025 is issued for online registration for web-based : I I t I i ,:4.: / 5 counselling to determine state Merit position for admission into competent authoriry quota seats only i.e., the seats in Government Medical/Dental colleges after deducting 15o/o of seats conrributed to AII India erota and Gtegory A seats in Private Un-aided Non_Minority and Minoriry Medical C_olleges, Private Un-aided Non_Minority Dental Colleges including Army College of Dental Sciences, Secunderabad. The admissions to the comperenr aurhoriry quota in the State of Telangana of course would depend upon the cutoff scores or above obtained in the NEET examination. The conduct of NEET examination per rc does nor amount to initiation of admission process in the medical institutions in the State under the competent authority quota. Section 4 of the Act of 2025 full force ro the ongomg would, therefore, apply with admissions to MBBS/BDS course under the competent authority quota in the state of Telangana since it has been initiated after corning into force of the Act of 2025 by 6 notification dated' 15.07'2025' Therefore' the grievance of the petitioners is misconceived'

6. 'We have corsidered the submissions of learned counsel for the parties and referred to the relevant dates and notificatiors, which have relevance to the issue 1n controversy'

Indeed, the notification for holding NEET examination' which is an eligibiliry test based on the cutoff scores of which' admissiors to medical institutions in the State or AII India quota are canied out, has been issued ot 07 '02'2025' Filowever, passing of the NEET examination or obtaining qurliflrtg marls therein per se does not amount to admission into the medical institutions under the competent authority quota in the State- 8 The process for admission to MBBS/BDS coune under the competent a$hority quota in the State commenced I i I I I + < *.F 7 from 15.07.2025 as perthe said notification. Rule 4 of the Act of 2025 operates prospecdvely and it reads as ,nder: "The provisions of this Act shall not be made applicable to the notifications/adverrisements w4rich have alreadybeen issued and nor ,;;; for appointments in public service or admissions lnto educational institutions, Pnor to the comrnencement of this Act.',

From the above, it is ciear that Rule 4 of Act of 2025 shall not be made applicable to notificatiors,/advertisements which have already been issued and nor fndrzEd for appointments in public service or admissions into educational irstitutions prior to rhe commencemenr of the said Act. The process for admission iruo MBBS,/BDS course in the State of Telangana has commenced. on 15.07.2025. Rule 4 of Act of 202i, therefore, does nor operate as against prospective admission process into educational institutions.
