Learned senior counsel for the petitioner submits that the respondent No.1 has issued the impugned refusal 2 , SK,J W.P.No.22304 of 2O2S order dated r2.o2-2o25 on the ground that the respondent No'2 has issued retter No.EcIR /Hyzo / 02 /2o2o / g*og dated 20.rL.2024 and in similar circumstances, this court has disposed of w.p.No.31699 of 2023 dated 03.o7.2o2s and requested to pass similar order in this writ petition by setting aside the impugned refusal order r,r,ithout reference to the letter issued by the respondent No.2. 4' on the other hand, rearned Assistant Government Pleader fr:r stamps and Regisr-ration has not disputed the submission made by the learned senior c.unser for the petitioner with regard to disposal of w.p.No.3 1699 of 2023 dated OS.O7.2O2S. 5' Learned standing counser for the respondent No.2 submits that pursuant to the interim order passed by this court in w.p.No.223o4 of 2o2s dated 0s.og.2 o2s, the respondents have registered the d.cument presented by the , / 3 SK, J W.P.No.223O4 of 2025 / petitioner €rnd in view of the same, the cause in the writ petition does not survive. 6, The relevant portion of the order in w.p.No.31699 of 2023 dated o3.or.2o2s in para Nos.7 and g is extracted as under; "7. For better appreciation, the Standing order No.219(b) of the Registration ancl Stamps Department is extracted as follows: "s.o.219.(b) If a court restrains a pcrson from arienating a property and if he still choses to alienate it, it is he who contravenes the orders of the cotrrt and not the Registering officer. If, on the other hand, the court gives a direction to the Registering oflicer/ Registration Department, the officer/Department is estopped from going ahead with the registration.,, ?

In the instant case, u'ithout any notification under section 22-A of the Registrar.ion Acr, r90g, by stating that the subject property is under prohibited rist for registration or no orders as pcr standing order No.219(b), the respondent No.3 has stopped the registration of the subject document. Therefore, the impugned Memo issued by the respondent No.4-GHMC vide Lr.No.62 /DCp/cLgl \ \ I I I I i I I l 4 SK, J W.P.No.22304 of 2025 GHMC/2O21 dated 22.11.2021 to the respondent No.3 cannot be taken into account. The above finding of this Court squarely apply to the facts of the present case.

7. In view of the said submissions and following the order passed by this court in w.P.No.31699 of 2023 dated 03.07 .2025, the Writ Petition is disposed of by setting aside the lntimation of Refusal vide Letter No. 1 89 12025 dated L2.o2.2025. There shall be no order as to costs.
