The Inspector General of Firm & Registration, A.P., Hyderabad, and others. …Respondents THE HON’BLE SRI JUSTICE V.V.S.RAO WRIT PETITION No.13533 of 2005 ORDER: The petitioner is a member of South Andhra Luthern Church (SALC), Nellore. Aggrieved by the action of the fourth respondent in electing members of the Church Committee, the petitioner allegedly issued legal notice on 27.04.2005 to respondent Nos.1 to 3 herein requesting respondent Nos.1 and 2 herein to declare the eligibility of Government Employees to participate in the affairs of the Society, to cancel the membership of the office bearers who were shown as Government Employees, to order enquiry into the unlawful sale of properties of the Society by the self styled Bishop President and the Government Employee who figured as officers of SALC, and to appoint a receiver to look after the affairs of the Society. Complaining inaction on their part, the present writ petition is filed seeking appropriate directions. Though interlocutory matters are listed, it is brought to the notice of this Court that under Section 23 of the Andhra Pradesh Societies Registration Act, 2001 (for short ‘the Act’), in the event of any dispute in respect of any matter relating to the affairs of the Society, the remedy is to file an application before the District Court concerned or to seek arbitration under the Arbitration and Conciliation Act, 1996. Keeping this in view, the first respondent may dispose of the notice issued by the petitioner. Liberty is also given to the petitioner to seek redressal before the appropriate District Court. The Writ Petition, with the above observations and directions, is dismissed. No costs. ____________
