3. This court by order dated oz.og.2o24, passed the followingl order,: "21. hinciples of natural justice have a universal application and eonstitute an important facet of procedural propriety. Principles of natural justice apply not only to State action btrt also to a Tribunal or Authorit5r, charged \Mith tJ:e duty and function of deciding a matter. In tl:e present case, no notice was glv91 nor an opporttrnity has been granted to the petitioner before reverting from the post of Head Constable to that of Constable. Hence, it is a clear case of violation of principles of natural justice. Non :issuance of notice and/or an opporturrity are not rlisputed. 22. Considered the submissions, having perused t.he record, tJris Court is of flre .pinion that pititioner be permittdd to make a represent:rtiori to the <:oncerned authorities narrating all the facts (including the fact that qhe was sent for pre_ promotional training to the post of Head constablLe i, the year 2Ol2 and completed training). Respondent Authorities shall provide an opporturiity of irearing, consider flre explanation offeiea by petitioner and shall pass orders in acaorctance with iarv. petitioner tr) make a representatiorr to the conccrnecl authorities '.vit].in a periocl of r:r.ro (o2) weeks from the 2 JAK,J cc 1975 2025 date of receipt of a copy of this order arid thereafter, respondent authorities shall pass ordr:rs within a period of two (2) nronths. Needless to state that, proceedings dated O9.O2.2OL8 and consequential proceedings dated L2.O2.2018 are set aside, for want of adherence to principles of natural justice."

Today when the matter is called, the order/proceedings of tlre oflice of Deput5r Inspector General of Police, Znne I, Kaleshwaram, Ramagundam, dated O4.OE.2O25, are placed on record, the contents are as follows: "Anent to the subject cited above, it is to inform that, tJre remarks on the following points with regard to implementation of Hon'ble High Court Orders dtd. O7-O8-2O24 in WP No.l1785/2018 filed by Smt. L. Rajamarri, WHC 1OO4 of Ramagundam Qsmmissisnerate for promotion as Head Constable with her batchmates received vide reference 6th cited above, the Superintendent of Police, Adilabad has informed as follows. Smt. L. Rajamani, while working as WPC-IOO4 in erstwhile district, her name was considered in promotion panel of WPCs to WHCs along with her batchmates during the year 2OL2, but due to pendency of OE, she was not considered for next promotion as WHC along with her batchmates. (Her batchmates WPCs got promotion as WHCs as per Seniority list of WPCs on O8- l2-2OL2l. Later, the punishment of PPI for (2) years with effect awarded vide this offioe DO No. 379712015, dtd. 19-11-2015 was modified as PPI for (1) yr w/o/e on appeal vide this oflice DO No. 56012016, dtd. 13-02-2016 and again on her revision petition the same was modified to that of "Censure" vide Proc. No. 235lA3lPRl2016, dtd.3O-O5-2OL6 of the Inspector General of Police, North Z.one and this office DO No. 221112016, dtd. 13{6-2016 and the same was under currency up to L9-lt-20L6. But, the convertee PCs (Civil) have approached the Hon'ble High Court due to which the promotion of PCs to HCs (Civil) were kept on hold till the year L2|2OL7 ie., final orders in WP MP No. 42229/2016 in WP No. 3423A12016 and 305231201.7 (last v ,f 3 JAK,J cc 1975 202s ".p"taIe f'romotions of PCs to HCs (Civil) allected in erstwhile f ,aUU"a district on O2-O7 -2OL6 only') _-A; per the Government orders issued vide G'O'Ms' 11o.186, Home (Irgal) Dept., dtd'O8-l1-2016 and (i.O.Ms. No. 187 ifome- (Ireal) Dept', dtd'O8- 1 l-2OL6' tLave affected amendmeni to the TS&SS Rules by c.eleting the separate category for Women wherever rrentioied in the service rules a'd brougtrt all the f,o"t" in each rank under comfiron nomenclature and [o intersperse the seniority of Men & Women of all the existing individuals and as Per tJne amendments' Women from seniority list of Men -and ifr. the ,".,t of PCs to Sls(Civi$ existing, have been i:nterspersed in each rank and promotions shall have to b; effected against tl:e vacancies without cbserving the Gender. Rs pei the said Government orders the separate seniority lists of Men & Women were combined' due to which her narne was not considered, ne her name vlas placecl in the Combined Seniority list (Men & \Vomln) along with batch of O3-04-2005 and.there-is rro question was raised for consideration for 6,romotion of WPC-IOO4 duly taking h91 h separ.ate seniority of WPCs, after completion of her modified p,unishirent. But, the plgqotions of PCs to HCs ici"u1 were kept on hold till th9 f"g L2l2Ol7, due to rrhich Smt. L. Rajamani, WPC 1004 was not considered. Smt. L. Rajamani, WPC 1OO4 was promo!9q T \VI{C (Civili vide Order DO'No'49l20l8' cttd.l3.Ol'.2O18 of the Superintendent of Police' Adilabad (reported as HC on 13-01-2018) purely on temporary bisis without conferring arry probationary righis, but later the promotion 9f order of Smt' L' ttljamani, WPC-1004 as HC (Civil) was cancelled and re,Jerted to her substantive post of PC (Civil) Order I).O. No. l4g l2Ol8, dtd.O9-O2-2O18 Superintendent c,t Police, Adilabad', due to which she approEched. the t{on'ble High court and as per the interim directions c,f the Hon'ble High Court dtd'25-04-20l8, it is ordered for temporary continuance of promotion as f{C (Civil) to Srni. L. Rajamani,'WPC-1004, subject to the conditi.on that, she will not be entitled for any s,eniority or probationary right in the promoted post i.e., HC (Civil) and that these orders will be revierved trased upon the outcome of the judgment -of the t{on'ble Court in W.P. No.11785/2018 vide this ()rder D.O.No.236l2|l9, dtd'22'oi2'20Lq Siuperir^tenclent of Potce, Adilabad and also informed ( { 4 JAK,J cc 1975 2025 that, the services of Smt. L. Rajamani, WHC-10O4 rnay be rcgolarired w.e.f. 13-01-2018 only, as at the tim€ of her promotion there are clear vacancies of HCs available in erstrvhile Adilabad district. Therefore, the temporar5r services in r/o Smt. L. Rajamani, WHC-1O04, Mancherial Town PS, Ramagundam Cornmissionerate of Zone-l Kaleshwaram is regularized in the caCre of Head Constable w.e.f. 13.01.2018 FN and brought on to "B' list from the same date and placing her on probation for a perid of one year on duty within a continuous period of trvo years from the said date under rule L6 (b) of Telangana State and Sub- Ordinate Senrice Rules, L996. The Comrnissioner of Police, Rama.gundam is requested to take necessarJr action acccrdingly and send the probation proposals i.e., Spl. CRs in r/o the said WHC to this office for declaration of probation." 5. A Memo issr.led on 16.07.2025 is placed on record, whicf reads as follows: "A copy of memo received in this offrce vide reference 7tt cited in respect of Smt L.Rajamani, WHC- 1004, Mancherial Town PS of Ramagundam Commissioner of 7-one-I, Kaleshwaram is sent herewith. Ttre SHO, Mancherial Town PS is instructed to serve the above copy on above individual and send the dated acknowledged copy to this oflice immediate for onward transmission to 7-one-l office."
