In all these writ petitions, the petitioners have challenged notification dated 15.O7.2025 issued by the University, whereby the criteria for treating them as local I .l candidates lor the purposes of adrnission to NEE I (UG) 2025 examination for MBBS/BDS courscs in Telanpana has been prescribed as per Rule 3a of the 'feiangana Medical :rnd Dental Colleges Admission into MBBS and BDS Courses Rules 2017 as amended vide (l.O.Ms.No.33, dated 19 l07 /2024 issucd by Respondent No.1

The learned Division 3ench of this Court read down Rule 3(lll)(B) of the 'Ielangana Mcdical and Dental Colleges Admission (Admission in:.r MBBS & BDS Courses) Rules, 2017 (for short, "the 2017 Rules") as amended by G.O.Ms.No.33, dated 19.t)7.2024 vide judgment rendered on 29.O8.2.023 in batch of writ petitions vide W.P.No.21268 of 2023 and batch. 'r.'he reievant paragraph reads as under: "9 1. We have a.lready hcld that Rule 3(IIIXB) of 2017 Rules is violative of Articlc 14 of the Constitution ol India. An interpretation which advances the object nnd purpose of the Act has to be preferred.'lhc object of Rulc 3(lll)(Cl of 2Al7 Rules is to provide reservaticn for iocal candidates. In case the rulc is struck down then students from :rll ovcr the country shall be entitled to admission in medical coileges. 'lherefore, instead of striking down Rule 3(III)(B) of 2017 Rules, it needs to be read down. 'lherefore, wc read down l) Rule 3(lll)(B) ot 20 17 Rules and it is held rhar the aforesaid Rule shall not apply to permi lent residents of the State of Telangana. Thus, by reading down the provision in the manner indicated above sha]l also be in consonance of object of Article 371D(2)(b)(ii) of the Constitution of India i.e., of making special provision to the people of different parts of State for admission to educational institutions. Therefore, the va-lidity of Rule 3(lll)(B) of 2017 Rules is upheld as interpreted by us. Accordingly, the issue (viii) is answered." The learned Division Bench interpreted 3(a) of thre 2Ol7 Rules, as amended vide G.O.Ms.No.33, dated 19.O7.2024, to mean that the petitioners therein shall be eligible to admission in the medical colle ges in the State of Telangana, if their domicile is of State ol Telalgana or if they are permanent residents of the State of Telangana vide its judgment dated 05.09.2024 in W.P.No.2191O of 2024 and batch. The relevant paragraph reads as under: "87. For the aforementioned reasons, we direct that Rule 3(a) of the 2O17 Rules, as amended vide G.O.Ms.No.33, dated 19 .O7 .2024, wlll be interpreted to mean that the petitioners shall be eligible to admission in the medical colleges in the State of Telangana, if their domicile is of State of Telangana or if they are pcrmanent residents of tJle State of Telangana. It is stated at the bar that there are no guidelines / rules framed by the State Governmcnt to ascertain whether a studcnt is a domicile/permement resident of the State of Telangana. We, therefore, grant the l liberty to the Governrnent to frame the guidelines / rules to determine as to when a student can be consi(lered as a permanent resident of the State of Telangana- The cases of thc p€ titloncrs/ students who claim to be eligible under the aforesaid guidelines/ rules, whici-r may be framcd by the State Government, shall be ccnsidered by the University by application of those guidelines/rules in the facts and circumstances of each casc.'
4. The aggrieved State of Telangana and the University also rvent in appeal beforc the Hon'ble Supreme Court. The Ilon'ble Supreme Court vide its judgment dated
07.O9.2025 passed in SLI)(C).Nos.21536-2 i58B of 2024 set aside the impugned judgments. It uphcld the vires of G.O.Ms.No.33 of 2024 dated 19.07.2024. Apart from that it also took into note that the amendment prol;osed by the learned Advocate General as a proviso to Rule 3 would allay ald mrtigate the grievance ol those who claim that they were taken out of the State by compulsion of the movement o[ their parents outside the State by reason of a employment Government/All-India Services/ Corporations or Public Sector Undertakings constituted as an instrumentality of the State of Telar-rgana as also defence and paramilitar5z forces who trace their nativity to l the State, subject to the conditions thereunder. With only the said reservation, the Apex Court upheld the 2017 Rules as it stood amended in 2024. It also made clear that the admissions made in the previous academic year shall not be disturbed. Consequent to the said decision, the State ol Telangana issued G.O.Ms.No.150, dated 08.09.2025 with the following amendments to Rule 3(a) of the 20 17 Rules. "ln rule-3, for sub-rule (a), the following shall be substituted, namely:- "(a) A caldidate for admission into undergraduate courses under 'Competent Authority Quota' in Telangana should be Indian National/ Person of Indian Origin (PIO)/ Overseas Citizens of India (OCI) card holder and shall fulfil the following provisions: i) If the candidate has studied in educationa-i Institutions in such local area for a period of not less than four consecutive academic years ending with the academic year in which he appeared or as the case may be first appeared in the relevant qualifying exarnination. (or) ii) Where during the whole or any part of the four consecutive academic years ending w:th the academic year in which he appeared, or as the case may be, first appeared for the relevalt quaiifyir-rg examination, he has not studied in any educational institutions, if he has resided in that local area for a period of not less than four years imrnediately preceding thc date of commencement of the relevant qualifying examination which he appeared or as the case may be first appeared. iii) Local area herein means the State of Telangana. Further, in case the candidate has not studied in any educational institution ald has resided in the local area as stated at (ii) above, to be eligible for admission into undergraduate courses under'Competent Authority Quota', the candidate should have appearcd for the relevant qua-lifying examination in the State of Telangana: \ 6 L Provided that a candidate who studies outside Telangala for any period during the requisite four consecutive academic years ending witl-r the academic year in which he appeared, or as the case may first appearcd in the rele'rant quali$ring examination wiil eligible to be considered if they fall under any of the belo'a, categories: be,

In the prcsent batch of writ petitions try virtue of interim orclers granted by this Court, the petitioners were allowed to participate in the admission process as local I 7 candidates subject to the outcome of the civil appeals vide interim orders passed from tirne to time taking into note the judgment passed by the learned Division Bench of this Court in W.P.No.2191O of 2024 and batch dated
05.09.2024 whereby the provisions of Rule 3(a) were read dou,n.
6. Since the judgment of tl-ris Court has been set aside b1' the Hon'ble Supreme Court in the aforesaid civil appeals, the validity of G.O.Ms.No.33 has been upheld so lar as the criteria prescribed therein for determination of a local candidate. However, vide G.O.Ms.No.150, dated O8.O9.2025, the State has amencled the sub-rule (a) of Rule 3 of the 2017 Rules of G.O.Ms.No.33 in terms of the proposal submitted by the learned Advocate General before the Hon'ble Supreme Court during hearing of the aforesaid civil appeals. 7. The case of the writ petitioners to be treated as local candidate in terms of G.O.Ms.No.150, dated 08.09.2025 has to be verified by the University for arriving at a 8 decision as to whether they fail under the category of local candidate and are covercd by it
