4. Learnecl .\ssistant Government Pleac'ler arppcaring for tl-re appellant had ftrrther contended that though tlre rt,fcrence Court has reliecl upon Ex. Al- Sale Deed, datecl 11.11.1994, of Kupkal \zillagc, wherein, Ac.0-Il0 guntas of land was solcl for Rs.20,000/-

1. (', Rs.40,000/- per acre, without there being any basis, cnhanced thc conrpensatiorr to Rs.60,000/- per acre for the acguirecl lancl. Tlre Land Acquisitic,n Officel has already awardecl compensation at ,lL. 3 AKS,J & ETD,J A.S.No.3227 of 2004 Rs.40,000/- per acre for wet lands, hpwever, the Land Acquisition Officer has awarded only Rs.4,000/- per acre for dry lands When the reference Court has relied upon Ex.A1-Sale Deed, dated '17.77.1994, it could have awarded con.rpensation uniformly to wet lands as well as clry lands at Rs.40,000/- per acre. But, the reference Court could not have enhanced the ccimpensation to Rs.60,000/- per acre for the entire acquirecl lancl. The enhancemcut of compensation to Rs.60,000/- per acre uniformiy to fhe entire acquired lancl is not supported by any material evideuce The Land Acquisition Officer has rightly awarded compensation of Rs.40,000/- per acre for wet lands. The reference Court ought to have cuhancecl the compensation in respect of dry lands also to Rs.IO,OOOT- per acre. Therefore, appropriate orders be passcd in the appeal by fixing the compensation at Rs.40,000/- per acrl uniformly for the entire land acquired by the appellant.

On the other hand, learned $enior Counsel appearing for respondent Nos.64 to 85 had conterlcled that tl're reference Court, takinfinto consideration the potentiality of the acquired land and the 4 AJiS,.J & E'I'D,J n. S.No.3227 oI20O4 fact that thr: leLnd acquired was abutting Manclal I{eadquarter, has rightly enhancr:d the cornpensation to Rs.60,000/- pel' acre urrifornrly for the entire iicquirecl land. Therefore, there au'e no merits in tl-re appeal and the sar.ne is liable to be dismissecl.

This Court, having considerecl the rival sulrmissions rnade by the lcarnecl cor nscl for the parties, is of the consiclered view that the refererrce CourL has relicd upon Ex.A1-Salc Deccl, clatcd 11 .11.7994 As pcr the said Salc Deccl, thc value of the larrcl r^'as Rs.40,000/- pcr acre. Tl'rercfor,., the referencc Court coulcl not liave enhanced the compensatiorr to Rs.60,000/- per acre for the acquirccl land. Thc. enhanccrnent of compensation to Rs.60,000/- per acrc bv thc reference Courl is without any basis. Therefore, lhat portiorr of the ordcr of the rcference Court, wherein it h.rs t trhanct cl tl-rc compt'nsation t,r Rs.60,000/- per acrc for thc entir,r;rcrluircd lancl, is set asicle.
