Learned counsel appearing for the appellant had contended that the appellant-plaintiff has filed O.S.No.45 of \ 2O1l for partition and separate possession, rectification of entries in the revenue records and consequential rclief of permanent injunci ion ln respect of the suit schedule properties on the file of V Additional District Judge, Meclak at Sanga Reddy. The appellant-plaintiff has also filed I.A.No..l71 of 2O11 seeking interim injunction restraining respondent Nos.2 to 51 lrom alienating the suit schedule property' and the learned Judge has grarrted interim inj unctio n on

28.06.2011. However, at the instance of the respondents, the said interim injunction order was vacated on O9.09.20 i I . Aggrieved by the same, the present appeal has been fi1ed.

Learned courlsel for the appellant had further contended that on O8.O2.2O12, this Court granted stotus quo and the. same is being continued and during pendency of the appeal, some of the respondents have passed awa_v, and their lega-l representatives were brought on record. Learned counsel had further contended that the appellant had filed I.A.No. I of 2O25 before this Court seeking withdrawal ol the suit against respondent Nos. 28, 29,30,35, and 36. Learned ,a '- 1 I I I : :-1: : AKS.. & VRKR..I (ma (,8 2012 ' couns('l }'rad lurther contended that similiu- application $'as also filed before the trial Court for dismissal of the suit against respondent Nos. 28, 29, 30,35, and 36. However, in vie'*' of status quo order passed by this Court-, the trial Court is not in a position to pass appropriate orders. Therefore, let the trial Court be directed to adjudicate tl-re suit on its merits and the contesting parties be directed to maintain slatus quo, and the trial court be permitted to consider the applications filed b1 the appellant for rvithdrawal of the suit against sorne of the respondents, rvithout being influenced by the stafus quo order passed by this Court.

5. On the other hand, learned counsel for the respondents had contended that since the suit is of the year 2Oll and 14 vears have already elapsed, the trial Court mav be directed to dispose ol the suit at the eariiest, after giving an opportunity to al1 the parties.

This Court, having considered the rival submissions made bv the learned counsel on either side. is of the view that the present appeal can be disposed of ivith a direction to the trial Court to dispose of O.S.No.45 of 201 1 as expeditiouslv as possible and a-lso examine the applications -1 _{KS.. & \'R[R.J ( nra ()8 -lo I -l ' -- - ,l filed b-i' the appellant for r.vithdrarval of the suit in respect of some of the respondents, without being influenced bv the \ status quo order granted by this Court.

7. As far as I.A.No. I of 2025 is concerned, liberty 1S granted to the appellant to file the same before the trial Court for passing appropriate orders. In view of the same, I.A.No.1 of 2025 stands closed
