MADHAVI DEVI ORDER: WRIT PETITION No.2 1431 ()F 2025 This Writ Petition is filed declaring the action of the respondents in not releasing the amount of Rs._1,99,1O,301/_ with interest to the petitioner No.1 for supply of hsh seed for thc year, 2023-24 on the basis of the bills, as recommended by r.esptrndent No.7 vide Lr.No.373/C/2023, d.ated 23.O1.2024 and the amount of Rs. 1,54,4O,867 / - witln interest of petitioner No.2 for supply of fish seed for the year, 2023-24 on the basis of the submission of b ls as recommended by respondent No.g vide Lr.No. 136/C/ 2023, dated 26.02.2024, as illegal and arbitrary arrd consequently direct the respondents to pay the bilis.

2. Heard learned counsel for the petitioners, Iearned Government Pleader for Fisheries, appearing for respondents No.1 to 3, and 6 to 8, learned Government pleader for Finance, appearing for respondent No.2 and the learned Government preader for Revenue appearing for respondents No.4 and 5.

3. Learnefl counsel for the petitioners submitted that both the petitioners have supplied fish seed for the year 2023_24 and are entitled for payment of the amounts. I I \-.-.d;'- -ITI i 1

Learned Government Pleader for Fisheries, however, submitted th:rt there has been certain vigilance enquiry into the supply of hsh seed by some of the agencies and that the enquiry has been concluded and subject to enquiry, if the names of the petitioners are not rncludcd in the enquiry report, then the authorities would take steps to process the bills of the petitioners.

5. In vieu' of the above submissions, the respondents are directed to verify whether the names of the petitioners hnd mention in thc enquiry rcport and if the petitioners are not in any way parties in the said enquiry, the petitioners shall be paid the amount due with appropriate rate of interest.

6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs
