THE HON’BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1275 OF 2012

O R D E R: Petitioner preferred the present Criminal Revision Case by invoking the provision under Sections 397 and 401 of the Code of Criminal Procedure being aggrieved over the order dated 19.07.2012 passed in Crl.M.P.No.422 of 2012 in Criminal Appeal No.325 of 2012 the Metropolitan Sessions Judge, Cyberabad at L.B.Nagar, Hyderabad, whereby the learned Appellate Judge while suspending sentence of imprisonment imposed on the petitioner by the VIII Special Metropolitan Magistrate, L.B.Nagar, Hasthinapur, in C.C.No.250 of 2011 by judgment dated 03.07.2012 directed the petitioner to pay a sum of Rs.75,000/- (Rupees Seventy Five thousands only) within one month therefrom. Heard. Having perused the material on record and also heard the arguments of the learned counsel for the petitioner, this Court is of the view that the condition imposed by the Appellate Court while granting interim suspension of sentence awarded by the trial Court is certainly onerous in nature. Hence, the condition imposed by the learned Appellate Judge in Crl.M.P.No.422 of 2012 alone is set aside and the remaining portion of the impugned order shall stand unchanged. Accordingly, the Criminal Revision Case is disposed of. Miscellaneous petitions filed in this revision, if any, shall stand closed. 20th July, 2012 SUR _______________________ JUSTICE RAJA ELANGO
