It is submitted that petitioner/respondent No.7 ha s obtained a certified copy of the vakalat filed in the writ petition allegedly signed by the writ petitioners No.1 to 24. The petitioner/respondent No.7 fo rnd that most of the signatures in the vakalat are fabricated. On furthr,r investigation, the petitioner/respondent No.7 believed that the signatures r> petitioners No.4,6, 10, 12, 20, 23 and 24, which were affixed on the vakal; I on 25.10.2021 are forged. Petitioners No.4, 12, 20,23 and 24 are residing n foreign countries and petitioners No.6 and '10 are residing outside Hy Jerabad and thus, it is impossible for them to affix their signatures on the va (alat. lt is apparent that petitioners No.3, 7 and 17 have forged the signatur:; of the above said petitioners and fabricated the vakalat. ln that connection, the petitioner/respondent No.7 approached the Charmin:rr Police Station and lodged Complaint No.290822 dated 29.08.2022 requesting action to be taken against the writ petitioners No.3, 7 and 17. lndividual counter affidavits have been filed by th,: petitioners No.3,7 and 17 wherein it is stated that they are not aware whether retitioners No.4, 12, 20,23 and 24 are residing in foreign countries and that peti :ioners No.6 and 10 are residing outside Hyderabad. They did not know if flr I signatures of the petitioners No.4, 6, 10,12,20,23 and 24 are forged. lt is fur ther submitted that the allegation that the petitioners No.3, 7 and 17 have forge d the signatures of petitioners No.4, 6, 10, 12, 20, 23 and 24 is false. Petitione -r No.3, 7 and 17 did not coerce the petitioners to sign the Vakalat and ther is no offence of perju ry. Learned counsel for the petitioner/respondent N(.7 submitted that petitioner No.23 - Ms. Animalla Supriya W/o. Animalla Raju has filed separate application in l.A. No.1 of 2O23 for deleting her name from t le array of parties. It is contended by her that her signature in the Vakalat was I rrged. Mr. Mamidi Sai Yadav, learned counsel for petitionr: No.23, submitted that the Vakalat was signed on 25.10.2021 and as on that d;l e, petitioner No.23 was in Abu Dabi. Thus, the question of petitioner No.23 s inging the Vakalat does not arise. Petitioners No.3,7 and 17 have not chosen to fil,: affidavit of other petitioners denying that their signatures in the Vakalat are f: -ged. Thus, this Court is ot the prima facie view that petitioners No.3, 7 and 17 have forged the signatures of petitioners No.4, 6, 10,12,23 and 24. Accordingly, this application is allowed.
