The Court made the following: COMMON ORDER THE HON'BLE SRI JUSTICE J. SREENIVAS RAO l.A.Nos.2 and.3 of 2022 IN/AND CRIN'IINAL PETITION No.7767 of 2021 ORDER: This Criminal Petition has been filed by the petitioners seeking to quash the proceedings in C.C.No.3090 ol 2021 on the flle ol the XXII Additional Chiet Metropolitan Magistrare, at Secunderabad, rvherein, the petitioner r.r,as made as an accused No.1 for the offences punishable under sections 406,420,467,468 and 4l I rlw 120-B of the Indian Penal Code, 1860

During the pendency of this criminal petition, petitio ner/accu sed No.1 and respondcnt No.2/de-tacto complainant have entered into compromise to resolve the disputes pending between them and filed joint affidavit along with I.A.No.3 of 2022 and also filed LA.No.2 of 2022 to record the compromise and to compound the otfences 3 . Upon perusal of the record, it reveals that this Court, by order dated 05.08.2025, directed the petitioner/accused No.1, Respondent No.2/de facto complainant, and respondent No.3 to 2 appear belbre the Sccretary, Telangana High Court Legal Services Committee, along with theil identity cards for the purpose of identification on 12.08.2025. In compliance with the said order, tl.re petitioner/accused No.1 and respondent No.2 appeared before the Secretary Telangana High Courl Legal Services Committee However, Respondent No.i lailed to appear. Accordingly, the Telangana High Court Legal Services Committee has submitted its report dated 12.08.2025

4. During the course of hearing, Sri A. Govinda Reddy, learned counsel for the petitioner, submittcd that the petitioner is not seeking any relief against respondent Nos.2 and 3, and that they '"vere impleaded as proforma respondents solely on the ground that respondent No.2 had lodged a complaint against the petitioner based on information furnished by respondent No.3, aileging that the bank guarantee provided by the petitioner was not genuine. He further seeks to withdraw the criminal petition against respondent No.3, and prays that the compromise entered into between the petitioner/accused No.l and respondent No.2/de facto complainant be recorded, pursuant to the joint memo hled by the parties. 3

5. The above said submission was not disputed by the Ms. Mounika, learned counsel representing Mr. P.Subash, leamed counsel lor lespondent No.2

6. Accordingly, criminal petition insotar as rcspondent No.3 is concemed, is dismissed as withdrawn !

Both the learned counsel submitted that the petitio ner/accuscd No.1 and respondent No.2 cntered into complorrise at the intervention of their'"ve11-'"vishers and eldcrs and settled their disputes. The terms of compromise were mentioned in the joint affidavit filed in support of I.A.No.3 of 2022

8. l.aking into consideration the above t'acts and circumstances including .joint memo filed by both the partics, proceedings in C.C.No.3090 ol 2021 on the flle of the XXII Additional Chief Metropolitan Magistrate, at Secunderabad, against the petitioner/accused No.1 is liable to be quashed.

9. Accordingly, I.A.Nos.2 and 3 of 2022 are allowed. Consequently, the criminal petition is allowed and the proceedings in C.C.No.3090 of 2021 on the hle of the XXII Additional Chief Metropolitan Magistrate, at Secunderabad, against the 4 petitioner/accused No.1 are hereby quashed.
