Learned Additional Solicitor General of India r.lrpearing for the petitioners had contended that the respondents r;r,e filed the subject O.A.No.763 of 2022 claiming that they are ent t[:d to switch over to the revised pay structure of 6th pay commi:; ;i;n from the time of 3'd promotion to the grade of Loco Pilot (Goo,. sr in terms of the Railway Board instructions, dated 19.09.201.6, c r:ulated airje Serial Circular No.5 of 2017, dated 19.01.2017, and to fi r their pay on :! 2 ., I AKS,J & ETD,J W. P.No.21040 of 2025 notional basis from the time of the said 3'd promotion nll 79.09.2016 in terms of Railway Servants (Revised Pay) Rules,2008 and release arrears of pay and other allowances from 20.09.2015 .onwards by granting all other consequential benefits. The Tribunal zrlde impugned order, dated 78.06.2025, observing that there was delay on the part of the petitioners in filing reply affidavit in the subject O.A. and that the petitioners are not serious about the matter, directed the General Manager, South Central Railways, to appear before it on 22.07.2025.

Learned Additional Solicitor General of India had further contended that the petitioners have filed their reply affidavit in the subject O.A. along with an application seeking to vacate the order, dated 18.06.2025, besides filing an application to dispense with the appearance of General Manager, South Cenkal Railways. But the Tribunal has not considered the said dispense with application and directed to list the said dispense with application along with the subject O.A.oide order, dated 15.07.2025.
