VIJAYSEN REDDY WRIT PETITION No.21158 OF 2025 ORDER: (oRAL) This writ petition is filed seeking to declare the action of respondents No.3 and 4 in interfering in the civil disputes pending between the petitioner and respondents No.5 to 19 in respect of the subject land admeasuring Ac.0-18 guntas in Survey No.172lEE, situated at Kompalty Village, Bhupalpaly Mandal, Jayashankar Bhupalpally District, without fottowing due process of law, as being illegal, arbitrary and unconstitutional.

Mr. B.Sridhar, learned Assistant Govemment Pleader for Home' ,basing on the written instructions datecl 22.07.2025, submitted that respondents No.5 to 9 submitted representation dated 04.07.2025 to respondent No.2 - the Superintendent ofPolice, Jayashankar Bhupalpally District, regarding the subject property which was forwarded to respondent No.4 - the Station House officer, Bhupalpally Police Station. Thereafter, respondent No.4 called the petitioner and respondents No'5 to 19 to the Police Station for the purpose of enquiry' On enquiry' it was revealed that the subject property is involved in suit in o.S. No.1057 of 2022 filed before the learned Principal Junior civil Judge cum Judicial a I I I I I 2 Magistrate of First Class, Bhupalpaliy. After completion of the enquiry, respondent No.4 suggested both the parties to approach the civil Court for redressal of their claim. It is submitted that enquiry repoft was sent to respondent No.2. Learned Assistant Governrnent Pleader further submitted that the following criminal cases in respect of the subject property are pending with Bhupalpally Police Station: i) Crime No.9 t of 2023 registered for the offences punishable under Sections 294P, 447, 427, 323 and 506 read with Scction 34 of the Indian Penal Code (lPC) wherein charge sheet has been hled vide C.C. No. I 178 of 2023 and the same is pending for trial; ii) Crime No.173 of 2023 registered for the offences punishable under Sections 447 and 427 read, with Section 34 of the IPC wherein charge sheet has been filed vide C.C. No. 1026 ol 2023 and the same is pending for trial; iii) Crime No.464 of 2022 registered fbr the ofTences punishable under Sections 147 and, 427 of the IPC wherein charge sheet has been filed vide C.C. No.937 of 2023 and the same is pending lor trial and; iv) Crime No.1 10 of 2023 registered for the offences punishable under Sections 447 and 379 of the IPC; Sections 3(2)(v), 3(1)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. o a' ..t*ry::. , ...-: -'.1. ,','.jt... 3 3 . This writ petition is disposed of directing respondent No'3 not to interfere in the civil disputes pending between the petitioner and respondents No'5 to l9 in respect of the subject property without loltowing due process of law. However, if respondents No.5 to 19 are, in any way, aggrieved by this order, they are at liberty to approach this Court seeking modification of this order. Respondent No'4 is deleted from the array of parlies as no personal allegations are made against him' There shall be no order as to costs.
