The petitioner is the NGO,s Colony Wellare Association being represented by its Executive Member filed the present writ petition with a prayer [o declare the action of the respondents No.3 and 4, Assistant Commissioner of police and Station House Officer, Vanastharipuram, respectivery, in fa ing to Lake the action on the complaint of the peLitioner dated Og.OT .2025 agarnst the respondents No.S and 6, who are forcibly erecting the Ganesh Mandapams for participating in the Ga,esh Festival/Ganesh Navaratri at sector 5, Bus Stand, Vanastalipuram, Ranga Reddy Drstrict, (hereinafter referred to as ,the subject piaceJ as illegal and arbitrary and with a consequential prayer to direct the respondents not to permit the respondcnts No.S and 6 lor erecLing the Ganesh Mandapams. 3. The learned counsel for the petitioner would submit that the rcspondents No.5 and 6, under the guise of performing Ganesh Navratri scheduled to be held from 27.08.2025 to O8.Og.2O2S, are trying the erect permanent structure over the subject place, which has been allotted by the Hyderabad City trmployees Societ5z for RTC Buq Stand purpose named as Bus Terminus by using shelter and lree moving of RTC buses and for easy access for general public. t j 2 a A11 the neighboring houses and colony people have objected for erection of the Ganesh Mandapams. It is furll1er submitted that in years 2023 and 2024 the respondents No 5 and 6 rvhen tried for erection of Ganesh Mandapams, complaints were made by the petitioner ancl other colony people and u'ith great difficulty thc respondents u'ithdrew their attempts lor permanent temple' Again this year, the respondents No.5 and 6 are influencing the ruling party leaders for erecting Gancsh Mandapam and thereafter to make a permanent structure over the subject place ln this regard, petitioncr madc a complaint before the respondents No 2 and 3 on 09 07 2025 to stop the erection of Ganesh Mandapams at Lhe subject place but the respondents No.3 and 4 are not taking any action against the respondents No.5 and 6 to slop erection of Gancsh Mandapam at lhe subject placc. Hencc, the petitioner hled the present writ petition' The learned counsel appearing for the respondents No 5 and 6

4. would submit that the proposed Ganesh Mandapam is only temporary struclure that \[rlou1d be removed after the Ganesh Idol immersion.

The learned Assistant Government Pleader for Home placed a copy of the written inslmctions dated 76 07 '2025 and would submit L that the petitioner has given complaint on o8.o7.2O25 to the Station House Ofhccr, Vanasthalipuram Police Station, stating that the unofficial respondents No.5 and 6 are constructing Ganesh Maldapam over the subject . place Based on the above comPlaint, the respondent No.4 made G.D. enlry on tlre same daY i.e. on / ::.: I I

08.07.2025 and enquired and directed the respondents No.S and 6 not to make any constructions without obtaining permission from the concerned authorities. It is further submitted that for installing Ganesh ldors in public places during the Ganesh Navaratri Festival, the organizers shall have to obtain prior permission from the police and so far, the respondents No.5 and 6 did not apply for permission and if the lespondents No.5 and 6 will make any application seeking for permission, the same will be considered keeping in view the difficultics expressed by the petitioner. 6' At this stage, the learned counsel for the respondents No.S and 6 submitted that they will make an application seeking permission from the concerned police for erecting temporary structure for celebrating thc Ganesh Navratri and the same will be removed after the Ganesh ldol immersion. 7 . In tha L vie w of I he matter, recording the submissions made by the learned counsel for the parties, this writ petition is disposed of giving liberty to the respondents No.S ald 6 to make an application to the concerned police seeking permission for erecting the temporary Ganesh Mandapam and thereafter, the respondents No.3 and 4 sha consider the same and act in accordance with law keeping in view the difficulties expressed by the petitioners.
