The petitioner is claiming that he is the absolute owner and possessor of land admeasuring Ac.4-00 guntas 1n Sy.No.545 situated at Chennur Village and Mandal, Mancherial District on the strength of registered agreement of saie./General Power of Attorney u'ith possession vide document bearing Na.522812OI7, dated 20:6.2Ci7. He has submitted on-line application bearing ID.No.GPA2400004812, dated 09.10.2024 w'ith responcient No.2 with d request mutate his name and issue and issue e pattadar passbook. Respondent No.3 has passed order dated 2l .1O.2024 stating that the person who executed G.P.A. is not having any title as per the Dharani Portal and do not possess the e-pattadar passbook. Further G.P.A. was executed with possession, but vide judgment and decree in O. S. No. 10 / 2Ol7 there is permanent injunction against Smt.Varala Mutha Laxmi. 2

A perusal of the record would reveal that Smt.Mukta Bharathi and another filed O.S.No. lO of 2Ol7 (old O.S.No.23 of 2015) pending on the file of II Additiona.l District and Sessions Judge (FTC), Mancherial, for declaration of title and for Perpetual Injunction over the suit schr:dule property therein. Vide judgment dated 27.O2.2O79,learned trial Court dismissed the said suit insofar as declaration of title is concerned and granted permanent injun:tron. Feeling aggrieved b,v the said judgment and decrc,e, petitioner's vendor i.e. Varala Mutha Laxmi and defendar.t Nos.2 and 3 preferred an appeal in A.S.No.21l of 2019. The Appellate Court heard the said matter and reserved for judgment

The petitioner has submitted afcrresaid on-line application in Dharani Portal under alrp\ication for GPA/ SPA/ Executed GPA module for impiementation of aforesaid GPA document and respondenr: No.2 is the competent authority to consider the same. Respondent No.3 has to submit its report to respondent No. ll . Instead of sending report to respondent No.2, responden,- No.3 rejected the said request made by the petitioner. It is also the specific contention ol the petitioner that the aforer;aid suit was 3 decreed only insofar as Permattent In}nction is concerned i and appeal filed by Varala Mutha Laxmi and delendant Nos.2 and 3 in A.S.No.211 of 2079 is pending

5. In the light of aforesaid discussion, impugned rejection order dated 21.10.2024 is set aside. The matter is remanded back to respondent No.2 with a direction to consider the on line application bearing ID.No.GPA24O00O48 12, dated

09.1O.2024, submitted by the petitioner by putting the petitioner, plaintiffs and defendalts in O.S.No.1O of 2O 17 on notice and affording them an opportunity and pass appropriate orders afre sh in accordarce with 1aw. If respondent No.2 is not inclined to accept the request made by the petitioner, he shall assign specil-rc reasons, pass an order and communicate the same to the petitioner. However, he t shall complete the said exercise within thirty (3O) days from the date of receipt of a copy of this order
