MADHAVI DEVI ORDER: WRIT PETIT ION No.20303 0F 2025 This Writ Petition is fited declaring the action of the respondents No. I to 3 in appointing Non-Ofitcial Persons as In Charge Committee of 46 respondent-Karimnagar Cooperative Urban Bank Limited, Karimnagar under Section 32(7)(a)(ii) of the Telangana State Cooperative Act, 1964 (for short 'the Act) and in extending the term of Non-Official Persons In Charge Committee from time to time and for further period of six (O6) months by its order dated 23.06.2025 vide G.O.Ms.No.285, Agricultural and Cooperation (COOP-II) Department, as illegal and arbitrary.

Heard learned counsel for the petitioner, learned Government Pleader for Cooperation, appearing for respondents No.l to 3, Sri K.Vasudeva Reddy, learned counsel appearing for respondent No.4 and Ms.Pratusha Boppanna, learned counsel representing Mr.Nalin Kumar, learned counsel appearing for respondent No.S- Reserve Bank of India.

L.earned counsel appearing lor the petitioner submitted that Non-Official Persons In Charge Committee is not acting in accordance with the provisions of the Act and is also not acting in transparent and fair manner, therefore, the petitioner is seeking \\ \ l \"' 7 -l appointment of Persons In Charge Committee by the officials of the Department till the elections are held for the Managing Committee.

I-earned counsel appearing for the 4th responderr t-Karimnagar Cooperative Llrban Bank Limited, Karimnagar submrtted that the process for conducting elections has been initiated anrl voters list is also finalized. He further submitted that pursuant t() the direction of this Court in W.P.No. 19460 of 2025, dated 15.O7.2o25, Elections will be held very soon. The allegation of mis managt:ment and not conducting al'fairs of the Society in a fair and transJlarent manner are not correct and substantiated.

5. I-earnecl Government Pleader appearing for Cooperation has produced written instmctions received by him, according to which the voters list has already been prepared but due to some discrepancies in the same, the proposals were returrred vide letter dated 25.06.2025.

6. After hearing all the parties, this Court finds that thcre is no provision under the Act to appoint only offtcial pt:rsons as the Persons In Charge of the Cooperative Banks or anr, other Society. Non Official Persons In Charge Committee has been rrppointed and if the petitioner has any grievance against functioning of the said Committee, he can always make a representation to lhe Registrar of thea(bbperative Societies who shall look into the samt. -1

Though learned counsel for tl-,e petitioner has liled additional material papers along with the Merno dated 12.Oa.2O25, this Court is not in a position to decide whether the activities being carried on by the Non Official Persons In Charge Committee are in accordance with the provisions of the Act, as they require verilication of facts. The grievance of the petitioner against the Non Official Persons In Charge Committee can be looked into by the Registrar of Co- operative Societies. Therefore, this Court is not inclined to interfere with the appointment of Non Official Persons as In Charge Committee ol the 4e respondent at this stage. Therefore, without going into the merits of the case and.rith liberty to the petitioner to approach the Registrar, the respondents are directed to proceed with the Elections as directed by this Court in W. P. No. 19460 of 2rJ25.

8. With the above direction, thc Writ Petition is disposed of. There shall be no order as to costs
