VINOD KUMAR Writ Petition No,20338 of 2025 ORDER: Heard learned counsel for the petitioners, learned Government Pleader for Home appearing for respondent Nos.l 'to 5, and with the consent of the learned counsel appearing for the parties, the Writ Petition is taken up for hearing and disposal at the admission stage.
2. Having regard to the manner of disposal of the Writ Petition at the admission stage and the nature of /s involved, this Court is of the view that notice to unofficial respondent Nos.6 to 12 is not necessary for adjudication of the present Writ Petition.
3. The case of the petitioners, in brief, is that, the 5th respondent is interfering in the civil dispute at the behest of the unofficial respondents herein without following due process of law, which actlon oF the respondents-authorities it is contended as highly illegal, arbitrary, unjust, u nconstitutional and violative of Article 21 of the Constitution of India.
4. Per contra, learned Government Pleader for Home appearing on behalf of respondent Nos.1 to 5, while denying the writ averments, would submit that on 06.07.2025, the respondents-authorities have received three dial-100 calls between 11.00 AM and 11.03 AM; that upon receiving the dial-100 calls, the patrolling vehicle visited the disputed land, wherein 2 .l:' the respondents-authorities have found that the petitioners and the unolficial respondents herein were quarreling claiming the subject land to be a disputed land; and that the authorities have advised both the parties not to create public nuisance as that may lead to law and order issue warranting initiation of necessary action by the respondents and directed the parties to approach the revenue authorities to resolve their dispute in relation to the subject land.
5. Learned Government Pleader further submits that the respondents- authorities, except ensuring maintenance of peace and law and order situation, are not interfering in the civil dispute between the parties or taking sides.
6. I have taken note of the respective contentions urged.
7. Having regard to the submissions made as above, since, it is stated that the respondents-authorities on receiving the dial-100 calls on
06.07.2025, having visited the subject land and noticing that both the petitioners and the unofficial respondents herein quarreling in relation to the subject land, which it is claimed as a disputed land, and having advised both the parties not to create public nuisance warranting initiation of necessary action by them, for maintenance of law and order, this Court is of the view that while the respondents-authorities are to be directed not to interfere in the civil dispute between the petitioners and the unofficial ._-'*fil ^t 3 respondents herein, however/ are directed to maintain peace and law and order situation at the subject site, in accordance with the provisions of BNSS and the Police Act.
8. Subject to above directions, the Writ Petition is disposed of. No order as to costs.
