2. Heard Mr. K.Ramachandra, leamed counsel fl ' the petitioner, Mr. L.Ravinder, leamed Assistant Government pleac 3r for Revenue appearing for respondent Nos.l to 4 and Sri Ch.Rr vinder, leamed counsel for respondent No.6. Perused the record.

3. Leamed counsel for the petitioner would submit the petitioner's husband has purchased the lands in Survey Nos. 7 )t/P2, 700tP3, 700/Pl,70llP5 to an exrent of Acs.0.lg, 0.13,

0.05 Yr, 0.13 respectively through registered sale deeds and respor dent No.l has issued proceedings No.ROR/32812007 dated 30.04.20( 7 to record the name of the petitioner's husband in respect of abor,, said lands in revenue records. After the demise of petitioners huril and, petitioner has submitted a claim petition in VI-A intimati r ; the fact of acquisition of right in respect of lands in Survey Ir| s.71P8,695P, 89P7,71P5,701P3, 700P3, 70lpt and 701 p2, to thr: extent of Acs.

1.23 guntas,0.05 gugnts, 1.28 gunts, 1.00 guntas,0.l: 3untas, 0.06 % 3 guntas,0.l8 guntas, 0.lg guntas situated at Boregaon Village, Renjal Mandal, Nizamabad District. pursuant to the said application, respondent has issued order vide bearing No.ROlVlT/20I4 dated _ -10.2014 directing village Revenue officer to record the names of the petitioner and her children in Form No.3 in respect of above said lands. Pattadar pass books have also been issued in favour of the pehtroner.

While things stood thus, he would submit that revenue authorities issued new pattadar passbooks vide Khata No.764, ppB No.T11210030456 dared 10.09.2019 to an extent of Acs.2.0250 guntas wherein land to an extent of Ac.0.1g guntas, Survey No.70llp2 has been deleted without issuing any notice to the petitioner and without following the due process of law as contemplated under law and has granted mutation in favour of resporident No.6. Aggrieved by the same, the petitioner has made an application under Dharani portal fide application bearing No.2300114755 dated 17.07.2023 seeking Missing Survey Number and Sub-Division and also made an application under Prajavani seeking to correct the passbook which is issued in violation of his own order in FiOF./ITl2}l4 dated _.10.2014. \---\ \-. ,-- 4 He would submit that respondent No.6 has filed srr : before leamed Principle Junior civil Judge, Bodhan for cancellati rn of registered sale deed and the said suit was transferred to Sen or Civil Judge, Bodhan and renumbered as O.S.No.96 of 2023 anrl that no interim order has been granted in the said suit. 5, The grievance of the petitioner is without follo,, ing due process of law, the extent of Ac.0.lg gunts in Survey No.7 )l/p2 has been deleted and further no action has been taken on the a.,plication made by the petitioner herein dated 17.07.2023. Hence., would seek a direction to official respondents to consider the ac rlication dated 17.07.2023 and prajavani application and thus, seek to pass appropriate orders in right ofno interim orders granted n the suit. 6. On the other hand, Sri Ch.Ravinder, learn: I counsel for respondent No.6 submits that it is apparent that petiticr er,s land to an extent ofAc.0. l8 guntas is deleted in new pattadarpass books and the petitioner has made application seeking correction of tre same, after lapse of five years which is sufficient to infer that th: petitioner has got no claim over the said property. He would furth rr submit that unofficial respondent is denlng the fact that sale i:ed has been a l 5 executed and on verification, it is revealed that the said sale deed is executed on a brochure by the petitioner and O.S.No .96 of 2023 filed by unofficial respondent is pending and admittedly, there is no interim order and since, the matter is before the learned Senior Civil Judge, he would submits that the indulgence of this Court is not warranted and therefore, would seek to dismiss the writ petition.

Learned Assistant Government Pleader for Revenue would submit that petitioner's application has been kept pending due to the pendency of Civil Court proceedings on the file of Senior Civil Judge, since official respondents are duty bound, no action is purported to be taken and therefore, seek to pass appropriate orders.

This Court having heard the learned counsel for the petitioner, leamed counsel for unofficial respondent and leamed Assistant Government Pleader for Revenue and upon perusal of the material available on record, it is seen as the fact that the official respondents has passed order vide Amendment No.ROR/I712014, dated -.10.2014, contrary to the said proceedings, new pattadar passbook has been issued to the petitioner herein deleting Ac.O.l 8 guntas without assrgnlng any reasons. Accordingly, without going into the merits anc lemerits of the case, official respondents are directed to communica.( the reasons to the petitioner as to why the land to an extent of A: 0. 18 guntas in Survey No.701p2 has been deleted from new pattadar 1 assbook issued to the petitioner, within a period of sixty (60) days i:m the date of receipt of a copy of this order. Till such time, the p:r ies to this writ petition shall maintain Status Quo obtaining as on todiL. . 10 With the above direction, this Writ petition s disposed of.
