With their consent, this writ petition is disposed of at the stage of admission.

Aggrieved by the. action of the respondent Nos.2 and 3 herein in refusing to receive and register the Sale Deed of the petitioner in respect of open Plot No.383 admeasuring 2OO square yards in Sy.Nos.19/20, 19122, 19/23, 19125, 19 126 and 19 148, situated at Lakshmi Meridian City, Ammapally Village and Narkhoda Grampanchayath, Shamshabad Mandal, Ranga Reddy District, the petitioner filed the present writ petition

Learned Assistant Government Pleader for Stamps and Registration submits that without presenting the document, the petitioner has approached this Court , slr, J W.P.No.2O14O oJ 2025 _1 seeking registration of the document. If the pctitioner presents the same befitre the Registering authority, the respondents will receive the same and loiloiv the procedure as contemplated under Section 71 of the Registration Act, 1908 (for short, the Act, 1908J.

The Section 71 of ttLe Act, 1908, reads zrs follows Rcasons for refusal to register to be recorclcd.- (1) Every Sub-Reeistrar refusing to register a document, except o]r the ground that thc l)ropcrty to which it relates is. not situated within his sub- district shall make an ordcr of refusal anci recorded his reasons for sucrh order in his Book No.2, and endorse the words "registration refusc<1,, on the document; and, on application made b_r. altv pcrson executing or claiming under the documcr.rt. shall, without payment and unnecessary deta_v, give him a copy of the reasons s;o recorded. (2) No registering officer shall accept for rcgistralion a document so endorsed unless and until, uncler thc provisions hereinaftt:r contained, the doc.ument is directed to be registered.

In view of the above made submissions coupled with the provision under Section 71 of the Act, 1908, this writ petition is disposed of dire,:ting the l?egistering Authority to b;l sr(' J w.P.No.2O740 of 2O25 receive, register and release the subject document, subject to the petitioner complying with the provisions of the Act, 1908 as well as the Indian Stamp Act, 1899' It will be open to the Registering Authority to refuse the document presented before him, if he has any objection, by duly assigning reasons in support of such decision and communicate the said decision to the petitioner' It is made clear that this Court has not expressed any opinion on merits of the case as to the entitlement of the petitioner to get the subject document registered. There shall be no order as to costs.
