Raman Goud, learned counsel appearing on behalf of the petitioner and tearned Government Pleader for Forests, appearing on behalf of respondent Nos,l to 6. 2. The petitioner approached this Court with the following prayer: " ...to issue a Writ, order or direction more particularly one in the nature of a Writ of Mandamus declaring the action of respondents in issuing impugned proceedings in Rc. No.tO54/2017/S2, dated 19-03-2021 and consequential proceedings of Conservator of Fo rests/Conserva tor of Forests, Warangal Circle vide Proc. No.535/202t/M9, dated 23-06-2021 rejecting the appeal petition dated 25.03.202L of the petitioner and subsequent rejection of revision petition dated 09.08.2021 of the petitioner submitted to the Principal Chief Conservator of Forests and Head of the Forest Force vide proc. No. t1098/202L/Prod.1, dated 19-05-2023 (wrongty typed as 19.05.20?-2) as arbitrary, illegal and against the principles of hatural justice and set aside the same and consequently direct the respondents to invoke and renew the license of the petitioners charcoal depot on merits forthwith and pass...". r 2 SN, J W.P. 3. The case of the petitioner, in brief, is that the petitioner is the owner oF Charcoal Depot in Sy.No. 411, Laxmakkapally Village, Kodakandla Mandal, Jangaon District. The respondent No.5 issued show cause notice No.LO54/20L7/52, dated 08'02.2021 aileging that on 22.12.2020 it was round that permission for conversio n of 254 cmt of prosophis Juli Flora fuel wood materiar into charcoar yierded 377 nos. of bags of charcoar and on 03.02.2O2t the Flying squad found 654 no. of charcoal bags i.e. in excess of 237 no. of bags than the permissible 417 (377 + 40 otd bags) and also found kilns arranged for burning without obtaining burning permission from the licensing aurhority. on 22.02.2021 the petitioner submitted a detaired reply to the show cause notice. However, the 5th respondent without considering the detailed explanation, had issued orders unilaterally vide Rc.No. tOS4/ZOl7lSZ, dated tg.O3.2O2L. Aggrieved by the said orders, the petitioner preferred an appeal before the 3'd respondent. However, the 3d respondent without considering the facts passed orders vide proceedings No.535/2021/M9 dated 23.06.202t rejecting the petitioner,s appeal. 5. A bare perusal of the impugned proceedings dated
19.O3.2027 issued by the 5th respondent clearly indicates that the fifth respondent failed to consider the explanation furnished by the petitioner and had issued the impugned orders unilaterally. A bare perusal of the impugned proceedings dated 23.06.202L passed by the Chief Conservator of Forests/ Conservator of Forests, Warangal Circle, Warangal vide Proc. No.535/202L/M9, dated 23.06.202t clearly indicates that the order passed by the 3d respondent is without assigning any reasons nor the said impugned proceedings indicate consideration of the petitioner's pleas as put forth before the 3'd respondent. The said order had been confirmed mechanically by the Principal Chief Conservator of Forests & Head of the Forest Force (HoFF), Hyderabad/2nd respondent vide Proc.No.11098/202L/Proc.l, dated 19.05.2023 in the revision preferred by the petitioner before the 2nd respondent dated 09.08.2021, aggrieved against the orderS passed by 3'd respondent in Proc. No.535/2021lM9, dated 23.06.202L. I I I I 4 SN, J W.P. No.21658 of2023 6, Takinq into considerataon : (a) The facts and circumstances of the case, (b) Duly considering the submissions of the tearned counsel appearang on behalf of the petitioner, The writ petition is allowed by setting asade the impugned proceedings dated 19.03.2O21 of the sth respondent, the Proc. No.535/2O2llM9, dated 23.O6.2021 of the 3'd respondent and the impugned proceedings of the 2nd respondent vide Proc. No.1lO98/2O2L/proc.l, dated 19.05.2023 and the subject issue is remitted to the respondent No.5 for re-considerataon afresh, duly considering all the pleas as put forth by the petationer before the 5th respondent and the 5th respondent is directed to pass appropriate orders in accordance to law, in conformity with the principles of natural justice, within a period of four (4) weeks from the date of receipt of a copy of this order, There shall be no order as to costs.
