This Petition coming on for hearing, upon perusing the Memorandum of Grounds of Criminal Petition and upon hearing the arguments of Sri tt/l.Anand I Kumar, Advocate for the Petitioners and the Sri Jithender Rao Veeramalla, Additional Public Prosecutor on behalf of the Respondent No. 1 and Sri Swamy Botla, Advocate for the Respondent No.2. HONOURABLE SRI JUSTICE N.TUKARAMJI l.A.Nos.3 AND 4 OF 2025 ln/A,nd CltlMlNAL PETITION No.8531 OF 2028 COMMON ORDER This Criminal Petition is filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS, 2023') seeking quashment of the proceedings against the petitioners/accused Nos l to 6 in C C No.5802 of 2022 on the file of the lll Additional Juclicial Magistrate of First Class at Warangal

The petitioners are arrayed as accused Nos.1 to 6 n the Calendar Case registered for the offences punishable under Sections 498-4 of lndian Penal Code and Sections 3 and 4 of Dowry Prohibition Act. 3 Heard lr/r. Vl Anand Kumar, learned counsel for the petitioners, Mr.Jithender Rao Veeramalla, learned Additional Public Prosecutor, representing the respondent No.'1-State and Mr.Swamy Botla, learned counsel for the respondent No.2/de-facfo complainant

The Secretary, High Court Legal Services Committee, has submitted report dated 18.07.2025 stating that the parties were identified by their respective counsel and also on verification of Aadhar Cards/ldentity Cards and the enquiries revealed that the parties have willfully and without coercion entered into settlemenUcom promise
6. I have considered the submissions of the learned counsel and perused the materials on record.
7. Having considered the allegations, the nature of charged offences I and taking into account the amicable settlement between the parties, in the light of the dictums in Gian Singh v. Sfate of Punjab and anotherl and Anit Mishra v. State of U.P.2; State of Madhya Pradesh v. Laxmi Narayan and others3, this Court is of the considered view that quashment of the impugned proceedings in view of the settlement by exercising jurisdiction under Section 482 Cr.P.C.l52B of BNSS, 2023, would be in the interest of justice. 2. It is submittcd that the issuc is rnarital discord betrveen the first petitioner and thc second respondent. Duling tl-re pendency of the said cases the petitioner No;1 and the second respondent h;we settled the issue amicabll' betweerl thern by deciding to paft ways mutually and they havo entered into a MOU dated 51712025 agreeing on some terms and conditions.
