Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the official respondents in not conducting survey in respect of land admeasuring in survey No.549/e, land admeasuring Ac.0-05 gts., and in survey No.551ie Ac.0-35 gts., situated at Kandukur Village, Kandukur Mandal, Ranga Reddy District., and to protect the land from the third parties and land grabbers from illegal dispossession of the petitioner as illegal, unjust, arbitrary, violative of principles of natural justice, consequently direct the official respondents to conduct survey and fix the boundaries for the rand admeasuring in survey No.s49/e, rand admeasuring Ac.0-05 gts., and in survey No.55'1ie Ac.0-35 gts., situated at Kandukur Viilage, Kandukur Mandal, Ranga Reddy District. 2. It is submitted that the petitioner claims to be the absolute owner and possessor of the aforesaid lands. It is further submitted that taking advantage of his land, as the boundaries are not demarcated, as per the sub-division of survey numbers, the neighbors along with land grabbers started harassing the petitioner and coming along with their henchmen. To that effect, petitioner made an applicaLion in Mee-Se va to conduct survey and fix the boundaries for the aforesaid lands uide application No.DERO224O 1090162, dated: 19.O8.2024. Th,e grievance of the petitioner is that cven after receiving the said application, the / I i I I i i 2 respondent authorities are not conducting survel/ lor fixation of the ! boundaries.
3. Considered the submissions o[ the learrled counsel for the petitioner :rnd learncd Assistant Govcrnment Plcader for Revenue appearing lor the respotrdenis and with their consent this writ petition is disposed of at thc admission stage.
4. Learned counsel for the petitioner has submitted that in terms of thc circular issued by the Commissioner, Survey, Settlements and Land Records, the respondents are bound to consider thc application r,t'ithin 45 days from the date of the application after collcctinfl neccssary charges.

Sri L.Ravinder, Lcarned Assistant Govcrnment Pleader for Revenue appearing lbr t he respondcnts has submitted that the respondent authorities will consider Lhe aforr:said application submitted by the petitior-rer by following due procedure laid down under law and conduct survey and demarcate thc subject iand by fixing boundaries.

It is settled law that the Surwey Dcpartment has the authority to conduct survey and demarcate lands in accordance with the provisions of thc Telangana Land Revenue Act, 1317 Fasli (Act No. Vlll of 1317 Fasli), the Telangana Survcl' arrd Boundaries 3 Act, 1923, and the Rules framed thereunder. The Government has issued various circulars specifying the conditions for conducting surveys, particularly F-Line (field measurement) surveys. Individuals requesting such survcys are required to submit specihc documents, and if the condi[ions stipulated in the circulars are fulfilled, the survey and boundary fixation may be conducted. The Commissioner, Survey, Settlements and Land Records, exercising powers under the Telangana Surwey and Boundaries Act, 1923, issued relevanl circulars from time to time vide Rc.No.Nl/6543/99, dated 25.07.2OOt, Rc.No.N1/ t4O8/ OZ, dated. 13.07.2OO7, and .Rc.No.N2/ 1741/2010, dated t8.OS.2Ol0 stipulating the conditions for conducting survey of private lands and as per the said circulars, if the petitioner fulhls all the conditions of the said circular, it is an obligation for the respondents to conduct surwey within the time specified in the said circulars.

In view o[ the aforesaid discussion, this Court deems it appropriate to dispose of this writ petition directing the offrcial respondents to examine the petitioner's application uide application No.DER0224O 1090162, dated: 19.O8.2024, in accordance with the provisions of the Telangana Survey and Boundaries Act, 1923 and also in terms of the circular instructions I I ._! 4 issued by the Commissioner, Survey, Settlements and Land Records for conducting survey on field measurcment applications (F-Line applications), from time to time, within a period of cight (8) weeks from the date of reccipt of a copy of this orcler, if not already conducted.
8. With the above observations, this Writ Pctirion is disposed of There shall be no order as lo costs As a sequel, misce llaneous applications pending in this petition, if any, shall stand closed.
