Counsel for the Petitioners : SRI RAPOLU BHASKAR Counsel forthe Respondents: SRI L.RAVINDER, AGP FOR REVENUE The Court made the following ORDER THE HONOURABLE SRI JUSTICE E.V.VENUGOPAL WRIT No.1973 of 2o.25 ORDER: This Writ Petition is filed praying this Court to declare the action of respondent No.2 in rejecting the succession application No.24o0 159 1 10, dated 15.03.2024 submitted by the petitioners seeking for mutation of their riames in all the revenue records and consequential issuance of pattadar passbooks in respect of the land admeasuring Acs.8 -27 guntas in Sy.No.l2 situated at Kasipet Revenue Village and Mandal, Mancherial district, without giving any valid reasons, is illegal, arbitrary, unconstitutional, violative of principles of natural justice and also violative of Articles 14, 2l and 3O0-A of the Constitution of India and consequently, direct respondent No.2 to mutate the names of the petitioners and issue pattadar passbook in respect of the aforesaid land and for other appropriate reliefs.

Learnr:d counsel for the petitioners would submit that the petitioners are the owners and possessors oI the land admeasuring Acs.3.27 guntas in Sy.No.12 srttrated at Kasipet Vilierge and Mandal, Mancherial District. Learned counsel foi the petitioners would further submit that originally the petitioner's grandfather by name Ramaiah was the Inamdar and his name was mutated in all the revenue records and he '*,as also issued pattadar passbook and after the death of their grandfather, their father by name Chinnaiah was cultivated the above land and the petitioners'father name w'as also mutated in the revenue records. Learned counsel for the petitioners would further submit that after the death of the petitioners' father, they are cultivating the said land and they have made succession application bearing No.24O0159110, dated

15.O3.2024 seeking for mutation of their names in the revenue records and consequential issuance of pattadar passbook in respect of the subject land under the provisions of the Telangana Itights in Land and Pattadar Passbooks Act, 2O2O (for short "the ROR Act, 2O2O") and the same was rejected by respondent No.2 without assigning anl :easons. Hence, this writ petiglon. 3 EVV, J Wp_19731_2025

Learned Assistant Government pleader for Revenue appearing for the respondents would submit that the petitioners' succession'application was rejected by the Collector as all the legal heirs have not given cons:nt. He would further submit that, unless and until atl the legal heirs of the deceased Inamdar give their consent by submitting joinq agreement, the respondent authorities have no power to consider the case of the petitioners.

This court has carefully examined the impugned order rejecting the succession application submitted by the petitioners for mutation of their names in the revenue records and t I consequential issuance of e-pattadar pass book in respect of the subject land. Except saying that the application submitted by the petitioners is rejected by the collector, no valid reasons whatsoever. has been assigned to enabie the petitioners to take appropriate action. Since the impugned order is not in consonance with the principles of natural justice, the same is liable to be set aside and accordingly, the same is set aside and respondent No.2 is directed to re-examine the application No.2400159110, dated t5.o3.2o24 submitted by the petitioners and if they are otherwise eligible and entitle, consider the same 4 EW-.
