Petition under Article 226 of the constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High court may be pleased to issue an appropriate writ, order or Direction more particularly one in the nature of writ of Mandamus declaring that the petitioner is entitted to have her claim considered and be absorbed as Junior Assistant on par with other similarly situated Village Revenue Assistants in accordance with orders rssued in G,o. Ms. No. B'l Revenue (Services-ll) Department dated 24-07-2023 and G.O. Ms. No. 85 Finance (HRM-l) Department dated 03-08-2O23 by considering proposals forwarded by the 3rd Respondent vide Rc. No. A101/2912023-1 dated 09-08-2023 with benefits incidental thereto in the interest of justice duly holding the action of the Respondents in not absorbing services of petitioner as Junior Assistant by keeping the proposals forwarded by the 3rd Respondent vide Rc. 2. Heard Sri V. Ravichandran, learned coutlsel for the petitioner and learned Government Pleader lor Sen'ices-l appearing for resPondents. 3. Learned counsel for the petitioner submits that the petitioner has been working as a Village Revenue Assistant in Metpalli vi1lage, Kannepalli Mandal of Mancherial District consequent to her appointment vide proceedings dated Ol .O5.2012. The Petitioner is entitled to have her claim considered and be absorbed as a Junior Assistalt in terms of orders issued in G.O. Ms- No. B I Reverue (Service s II) Department dated 24.O7 .2'.023. 3 (i) Lcarned coun s,el for the petition er lurther submits that the above Governmonl Order makes it clear that those Village Revenue Assistants having qualifications of Degree and above, are entitled to be absorbed as Junior Assistants. In furtherance t o above mentioned G. O . , orders u'ere issued in G.O. Ms.No.85 Finance (HRM-l) Department, dated 03.O8.2023 creating 14,954 supernun.erary posts in various categories for absorption ol Village Revr:nue Assistants and several VillESe Revenue Assistants u'ere absorbed against thc newly created supernumerary posts. 3(ii) Learned counse l for the petitioner further submits that at the relevant point ,rf time, the petitioner was pregnant and could not attend duties during the period from O1.O7.2022 to 24.O5.2O23. The petitioner, on completion of maternitl, period, had reported for dut,y on 25.O5.2023 and she was taken into duty ancl rs u'orking as; such til1 date. N or't' steps are being laken ' action has been laken to absorb more Village Revenue Assistants and petitioner's case is being overlooked once again on the alleged ground that her name is yet to be included in the porta-l mentioned supra' 4. Learned counsel for the respondents submits that for disposal of the proposal' they do not have any objection' 5. Having regard to the submissions made by the learned counsel for respective parties' this Court' without expressing a'ny opinion on the m6rits of the case' direct the 2nd respondcnt to consider the proposals forr'varded by the 3'd respondenl vide Rc.No.A101/ 29 12023-l' dated 09'O8'2023 and pass appropriate orders' in accordance with law' within a period of six (06) weeks from the date of copy of receipt of this order' 6.
