VINOD KUMAR W t o N 1 64 t ORDER: Heard learned counsel for the petitioner, learned Government Pleader for Home appearing for respondent Nos.1 to 3, and with the consent of the rearned counser appearing for the parties, the writ petition is taken up for hearing and disposal at the admlssion stage. 2. Having regard to the manner of disposal of the Writ petition at the admission stage and the nature of /b involved, this Court is of the view that notice to unofficial respondent Nos.4 to B is not necessary for adjudication of the present Writ petition.
3. The case oi the petitioner, in brief, is that, respondent Nos.3 and 4 are interfering with the peaceful possession, enjoyment, day to day business and life of the petitioner at the instigation of the unofficial respondents herein by calllng him to the police station and interfering in civil dispute pending between the petitioner and unofficial respondents 5 to B herein, without following due process of law, which action of the respondents it is contended as highly illegal, arbitrary, unjust and against the provisions of BNS and BNSS, with a consequential direction to the respondents not to interfere with the life and liberty of the petitioner and the conduct of his business. 2

Per contra, learned Government Pleader for Home appearing on behalf of respondent Nos.1 to 3, would submit that the 7t'' respondent in the present Writ Petition had approached the respondents-authorities and lodged a complaint against the petitioner on 03.07.2025; that on receiving the aforesaid complaint from the 7th respondent, the authorities have made a GD entry and after causing preliminary enquiry, have closed the aforesaid complaint as'civil in nature'on 08.07.2025.

Learned Government Pleader would also submit that the petitioner herein had approached the respondents-authorities and lodged a compraint on 04.07.2025; and that the respondents-authorities after making GD entry and causing preliminary enquiry thereinto, have also closed the aforesaid compraint as'civir in nature,on og.o7.2o2s and issued intimation of the action taken to the petitioner through petition Management System.

Learned Government pleader would thus submit that the respondents-a uthorities, except causing preliminary enquiry into the complaint lodged by the petitioner and against the petitioner, are not interfering in the civir dispute pending between the petitioner and unofficiat respondenrs herein, or interfering with the peacefurpo'se,S/,n or day to day business and life and fibedy of the peiltioner as a/eged, l 7' The aforesaid submission made by the learned Government pleader for Home appearing for respondent Nos,1 to 3 is taken on record. B. Having regard to the submissions made as above, and taking note of the fact that the complaint lodged by the petitioner and counter complaint lodged against the petitioner having resulted in closure as ,civil in nature' on 08.07.2025, this Court is of the view that the respondents_ authorities are to be directed not to interfere with the rife and riberty of the petitioner or in the civir dispute that may exist between the petitioner and the unofficial respondents herein, except in accordance with raw. 9.
