He has been in peacefur and continuous possession and enjoyment of the said rand. The respondent authorities issued Gazette Notification No.A3 /lS/2o2|dated lZ_O5_ 2025 under the Right to Fair compensation and Transparency in Land Acquisition, Rehab,itation and Resetflement Act, 2073, initiating acquisition proceedings for the Seetharama being the originar patradar/beneficiary between the respondents and certain private individuars namery pati Narasalrah, pati Madhava Rao, pati srinivasa Rao, pati Jhansi, Gujjarlapudi Sarduru, Naramothu venkateswarru, Gurram Jaggalah, sairi Aruna and sairu [Jma, his narne was ,regally removed from revenue records and repraced with those of the aforementioned individuars' The petitioner submitted objections against any disbursement of compensation to these indiyiduals. of the;:::tr: r":;";.: (a) Aggrieved by this arbitrary and illegal action, the petitioner instituted civil suit in o.s.No.436 of 2o2s seeking a perpetuar injunction and correction/mutation of the revenue records. The suit remains pending. Despite the pendency of the civil proceedings, the respondents are moving forward with disbursing compensation to UnaUthOfiZed perSOnS, which would cause irreparable harrn and Undefmine the pending litigation' The Petitioner subrnitted representations and issued legal notices reqrresting that no ,, /-- "- Page 3 of4 compensation be released until the suit is finally adjudicated. However, the respondents have taken no action nor provided any assurance. The respondents' actions in disbursing compensation to unauthorized persons are arbitrary, illegal, and in violation of Articles 14 and 3OOA of the'Constitution of India, depriving the petitioner of his lawful property without due process of law. (b) However, stating above, the learned counsel for the petitioner seeks liberty to file a detailed representation to the official respondents canvassing the claim of the petitioner seeking compensation. 4' The rearned Assistant Government pleader, representing the learned Government preader for Revenue and rearned Government Pleader for Land Acquisition reported no objection for the request of Iearned counsel for the petitioner to fire a detailed representation. Recording the above submissions, this Court deems it appropriate to grant liberty to the petitioner to file a detailed representation with respondent No.2, along with the relevant documents, to claim the land in question. Upon filing of such dehiled representation, if it is found to be in order and in accordance with the prescribed norms, the official respondents shall examine and consider the same in accordance with law, duly issuing notices to all interested .i J Page 4 of4 (-t and affected parties and after affording them an opportunity to be heard, dispose of the matter as expeditiously as possible, keeping in view the pendency of civil proceedings in O.S. No. 436 of 2025.
