Counsel for the Petitioner: SRI PADALA PRAVIN KUMAR Counsel forthe Respondent No. 1 to 4: AGP FOR REVENUE Counsel for the Respondent No. 5: C AVANI REDDY The Court made the following: OROER THE HONOURABLE SRI JUSTICE E.V.VENUGOPAL WRIT PETITION No.21285 of 2o.23 Aggrieved by the action of respondent Nos.2 to 4 for deleting the petitioner's land to an extent of Ac.O-2O guntas out of Ac.0-26 guntas in Survey No.438/D situated at Bommareddypalli Village, Dharmaram Mandal, Peddapalli District from Dharani and in new pattadar passbook and adding the same to respondent No.S without any proceedings, even though the petitioner is in possession of Ac.O-26 guntas in Survey No.438/D (herein after referred as subject property) situated at Bommareddypalli Village, Dharmaram Mandal, Peddapalli District, the present writ petition is frled. A consequential prayer is sought to direct respondent Nos.2 to 4 to record the petitioner's name in Dharani Portal and in new pattadar passbook in respect of Survey No.438/D to an extent of Ac.O-26 guntas instead of Ac.0-06 guntas, as per the proceeding / Memo No.B/2811/2OL9, dated 19.11.2019 issued by respondent No.4 by considering the petitioners' representations dated

2. Heard learned counsel for the petitioner, learned counsel for unofficial respondent No.5 and learned Assistant Govemment pleader for Revenue appearing for respondent Nos. 1 to 4.

3. l,earned counsel for the petitioner submitted that petitioner is the absolute owner and possessor of agricultural land admeasuring Ac.O-26 guntas in Survey No.438/D, situated at Bommareddypalli Village, Dharmaram Mandal, Peddapalli District, acquired by way of inheritance. The petitioner obtained pattadar passbook bearing patta No.424, showing an extent of Ac.0-26 guntas in the said survey number. However, upon issuance, the passbook reflected onlv Ac.O-06 guntas instead of the full extent.

It is further submitted that the petitioner,s old l-t] form, passbooks and pahanies clearly reflect possession of Ac.O-26 guntas, but the remaining Ac.o-20 guntas were deleted from the petitioner's khata and added to adjacent land owner (respondent No.S) without any notice or proceedings, despite the petitioner's continuous possession.

5. Aggrieved thereby, the petitioner submitted representations dated 24.09.2018, 20.12.2018 and 15.02.202I to respondent No.4 seeking correction of the revenue records. pursuant thereto, respondent No.4 3 conducted an enquiry and issued Memo No.B/28 Ll l2ol9, dated

19. 1 1 .2OL9, directing the Revenue Inspector as follows: "On perusal of the reard relating to Surueg No.438, it is obserued tlnt in Surueg No.438/C, pattadar respondent No.S was originallg halding Ac.0-38 guntai under Khata No.245, but h.e is found in possession of excess land. ltu R"r"nue In"spector i.s directed to examine and delete such exess extent fromhis khota."

6. Despite such direction, no further action has been taken, and the petitioner's rights remain unaddressed. The petitioner also submitted an application through Dharani Portal, but no steps were initiated by the authorities. T. Learned Assistant Government Pleader for Revenue submitted that petitioner's case is under consideration and assured that appropriate \ \ orders would be pass in due course of time.

8. Learned. counsel for respondent No.S also sought for passing appropriate orders. i I g. Upon hearing the parties and on perusal of the material papers, this Court is of the considered opinion that the matter requires consider.ation by the oflicial respondents. Accordingly, this Court directs the oflicial respondents to consider the petitioner's case and pass appropriate orders in accordance with law, as expeditiously as possible- The petitioner is granted liberty to submit a fresh representation, along 4 with a copy of online application under acknowledgment within a period of four (04) weeks from the date of receipt of a copy of this order to respondent No.4 and respondent No.4 shall examine rhe same and pass appropriate orders strictly in accordance with law within a period of eight (08) weeks from the date of receipt of such repres(-'ntation from the petitioner, after issuing notice to both parties and zrffording them an opportunity of hearing.
