The learned counsel for the petitioner submits that the petitioner is the pattadar and lawful owner of the subject agricultural lands, whose name stands duly mutated in all revenue records and pattadar passbooks have been issued. He purchased the property through registered sale deeds from the previous orvners and cultivated the land. Subsequently, wishing to develop a layout under the name "Muruti Townships," he applied for NALA conversion and respondent No.5 granted permission under proceedings No.2300o42024, dated
19.01.2023. Thereafter, the petitioner abandoned the layout proposal and decided to resume agricultural activity. consequently, he submitted a representation on LO.O4-2O23 requesting cancellation of the NALA permission and reconversion oI Ac.6.2g50 gts., into agricultural land. Respondent No.S, how,ever, failed to consider or dispose of the said representation. Repeated approaches to respondent / ,/ Page 3 of5 Nos.3 and 4 also yielded no action, though the NALA Act permits the pattade,r to seek cancellation of such permissions. (a) He further submits that this court, in w.p.No.3099 of 2023 and W'[)'No.41O97 of 2022, has already directed revenue authorities to cancel NALA permissions upon request of pattadars in similar circumsr-ances. Despite this, the respondents have failed to discharge their statutory duty, infringing the petitioner,s right to property. out of the petitioner's total holding of Ac.9.2g gts., only Ac.6.2g5o gts., is sought tc' be restored to agricultural use, as the remainder has already been devt:loped. Due to the persistent inaction of respondent No.5, the petitioner is left with no efficacious remedy except to invoke the extraordirlary iurisdiction of this Hon'ble Court under Article 226 of the Constitutirn of India.

The learned Assistant Government preader, representing learned Gc,vernment pleader for Revenue submits that the petitioner, having voluntarilv obtained NALA conversion through proceedings No.23o0o4'-2o24 dated i9.0 r .2023, cannot now seek its cancelration merely due to a change of personat intention. The NALA Act does not provide for automatic or unconditional reconversion of land once valid non-agricultural permission is granted. The petitioner has shonn neither stattrtory right to demand reconversion nor any mandatory duty on .Jtlg authorities ro cancel a legally issued NALA order. His Page 4 ofS representation dated ro.o4.2023 is already under consideration and any administrative delay does not amount to illegality. No violation of constitutional rights or principles of natural justice is established. The petitioner also initiated layout development and availed benefits under the non-agriculturar status and is therefore estopped from reversing his earlier position. The writ petition is premature, lacks merit and an alternative statutory remedy is available under the revenue raws. Accordingly, the writ petition is liable to be dismissed. 5' Having regard to the submissions made on either side and without entering into the merits of the rival claims, this court is of the opinion that the grievance of the petitioner can be addressed if the representation dated 10.04.2023 is considered by the competent authority' The only compraint of the petitioner is that though such representation seeking cancellation of the NALA Conversion Proceedings No.23 00042024, dated Ig.ol .2023, has been submirted, the same has not been disposed of tiil date. Accordingl-y, the writ petition is disposed of with a direction to the Stir respondent to examine and consider the representation of the petitioner dahd rc.O4.2O23 and pass appropriate orders stricfly in accordance with law, after affording due opportunity of hearing to the petitioner and any other affected parties' as expeditiously as possible. It is made clear that this court // Page 5 of5 has not expressed any opinion on the merits of the case and it is for the compete nt authority to take an independent decision.
6. With the above observations, this Writ Petition is disposed of. Thert: shall be no order as to costs.
