ORDER:

This writ petition has been filed by Mohd Abdul Khalid with a prayer to issue an order, writ or direction more particularly in the nature of writ of Mandamus declaring the order in proceedings No.10904/MP/MBBS/2010 dated 02-06-2010 including memo in Lr.No.10904/MP/MBBS/ EA1/2010 dated 20-04-2010 as illegal, arbitrary and violation of principles of natural justice.

When the writ petition came up for admission, Sri D.V. Nagarjuna Babu, learned Standing Counsel for the NTR University of Health Sciences takes notice on behalf of respondent No.1 and Sri Deepak Battacharjee, learned Standing Counsel takes notice on behalf of respondent No.2.

Heard the learned counsel appearing for the parties.

Learned Standing Counsel appearing on behalf of respondent No.1 submits that the order impugned in this writ petition is an appealable order under Section 55 of the N.T.R. University of Health Sciences Act, 1986 (hereinafter in short referred to as ‘the Act’ for the purpose of convenience).

In that view of the matter, the writ petition is dismissed reserving liberty to the petitioner to file an appeal as provided under Section 55 of the Act and on such appeal being presented by the writ petitioner the appellate authority has to dispose of the same within a period of two (2) weeks from the date of filing of the appeal.
