This writ petition is filed questioning the order passed by the Special Tribunal, Siddipct District in Case No.F3/Spl.Tribunal/ Maddur /28 /2O2t dared 02.O2.2021 corresponding to Old Casc No.D/2276/2O17 in dismissing the appezrl frled by the petitioner under Section 5(5) of the Telangana Rights in Land and Pattadar Passbooks Act, 2 SK, J \ .l'].No.27251 of 20'22 - 1971 (For short "ROR Act, IgTl") in resp ct of the iancl admeasuring to an extent of Ac.3_06 gt; in Sy.No.11g situated at Kootigal Village, Dhoolmitta Mi ndal, Siddipet District as illega1 and arbitrary and agains the provisions of ROR Act, 1971.

Learned Counsel for the petitioner s_ rmits that the personal notice sent to the respondent N( s.5 to 7 was served and hled proof of service before the il gist.ry in USR No.146900 of 2025 dated 17.12.2025. He gt rmits that the petitioner hirs questioned mutation of recor: the unofficirrl respondents before the Rever s in favour ol ue Divisional Officer, Husnabad under Section 5(S) of the F ald the sarne was numbered as Case No.[ OR Act, 1971 /2'276/2017. Pending the said appeal, the ROR Act, l9Zl vas amended and ROR Act, 2O2O came into force. He subr rits that alter reorganization of the Districts, Kootigal villagc jurisdiction of Dhoolmitta Mandal, Husn:L Division, Siddipet District and in view of the s the amendment of ROR Act, 2O2O, the appe.; petitioner was transmitted to the Special Tribt lalls into the )ad Revenue rmc and also filed by the nal, Siddipet SK, J W .P.No.27251 of 2022 3 and thereafter, the Special Tribuna-l without issuing any notice to the petitioner as well as the unofficial respondents has dismissed the appeal and the same is contrary to the orders of the Division Bench of this Court in W.P.(PIL).No.20 ol 2021 dated 18.O3.2021 and the impugned order has to be set aside and remand the matter to the appropriate authority 4 On the other hand, learned Assistant Government Pleader for Revenue fairly conceded that the Special Tribunal without issuing any notice to the petitioner as well as the unofficial respondents has passed the impugned order and also not disputed the order passed by the Division Bench of this Court in W.P.(PIL) No.2O ol 2O2l dated 18.O3.2O21 and requested to pass appropriate orders.

After hearing both sides ald perusal of the record, this Court is of the considered view that the petitioner has filed appeal under Section 5(5) of the ROR Act, 197 I before the Revenue Divisional Officer, Husnabad.
