Counsel for the Petitioner: SRI M.RAMGOPAL RAO Counsel for the Respondents: GP FOR SERVICES I The Court made the following: ORDER THE HON'BLE SRI JUSTICE NAMA VA PU ESHWAR o w T ETI ON 1 27 2 2 ORDER: The present writ petition is fired seeking to decrare the action of the respondents in not considering the case of the petitioner for mutuar inter-rocar cadre transfer from Mahabubabad District to Bhadradri Kothagudem District in accordance with G.o.Ms.No.245, GAD, dated 29.II.2024 read with G.O.Ms.No.21, GAD (SPF_I), dated 02.02.2022, as illegal and arbitrary.

2. Heard Sri M. R-am Gopal Rao, learned counsel for the petitioner, and learned Government pleader for Services_I, appearing for the respondents. perused the material on record.

3. The brief facts of the case are that the petitioner was appointed as a Secondary Grade Teacher in the year 2Ol2 and is presently working in Mahabubabad District. Following the reorganization of the State under the Andhra pradesh Reorganisation Act, 2014, cadre allocations were made vide G.O.Ms.No.317, cAD, dated 06.12.202I, placing the petitioner in Mahabubabad District. The Government, in response to representations from employees, issued G.O.Ms.No.21, GAD (SPF-I), dated 02.02.2022, taying down guidelines for inter_ local cadre mutual transfers. Later, the Government issued 2 G.O.Ms.No.245, GAD, dated 29.7I.2024, inviting online applications for mutual trilnsfers between OL.12.2024 and 3L't2'2024' The petitioner submitted his online application on 3l'12'2024, seeking mutual transfer to Bhadradri Kothagudem District with Banoth Naresh, a teacher in the same category. However, while other similarly placed candidates were granted mr.ttual transfers under G.O.Rt.\o.70, School Education Department, dated 21.03.2025, artd consequent proceedings were issued vide Rc.No.289lGeneral/ 2024, dated 28.03.2025, the petitioner's name was excluded without any reason or communication. Aggrieved by the same, the petitioner filed the present Writ Petition '

Learned c:unsel for the petitioner submits that the petitioner applied for mutual transfer on 3L.12.2024, within the time prescribed unde:r the relevant Government Orders, and meets all the conditions frr transfer. He also agreed to take the last rank in the new cadre. Several similarly placed candidates were granted mutual transfer;, but the petitioner was wrongly excluded without any explanation,

Learned C;overnment Pleader for Services-I, appearing for the respondents, submits that the petitioner's online application is pending with the Government, and that the Government, being the competent authority, will take a decision and pass orders in 3 accordance with the rules and eligibility criteria prescribed under G.O. Ms. No. 245, dated 29. II.2024.

Taking into consideration the submissions made by the learned counsel for the respective parties and on perusal of the records, this Writ petition is disposed of, directing the respondent authorities to consider the case of the petitioner for mutual inter_ local cadre transfer from Mahabubabad District to Bhadradri accordance with G.O.Ms.No.245, GAD, dated 29.11.2024, read with G.O.Ms.No.21, GAD (SPF_I), dated 02.02.2022, and pass appropriate orders in accordance with law, preferably within a period of six (6) weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Kothagudem District, Miscellaneous petitions pending, if any, shall stand closed.
