Counsel for the Petitioner : SRI RAPOLU BHASKAR Counsel for the Respondents : SRI L.RAVINDER, AGP FOR REVENUE The Court made the following: ORDER ( - t \w.L- TIIE HON'BLE SRI JUSTICE C.V.BHASKAR REDDY WRIT PETITION No.l 937L of2025 ORDER: This writ petition is filed seeking foliowing relief: "For the reasons stafed in the accompanying afhdavit, the petitioner herein prays that this Hon'ble court may be pleased to issue an appropriate writ, order or direction more particularly one in the nature of writ of Mandamus declaring the action o[ the Respondent No.4 & 5 in non-considering the Fline Application vide No. D8R022300923855, dated 18-04-2023 and non-initiating to conduct the Survey and demarcation in the land of the Petitioner to an extent of Ac.6-27 gts., in Sy.No.95/2, rvhich is srtuated at Polepalle Ramnagar ViUage, Chinthapalle Mandal, Nalgonda Drstrict and non initiating to fix the boundaries to the petitioner's land is iuegal, arbitrary and violative of provisions of Article 14, 15, 2l and Articte 300-4 of the constitution of India and also violative of provisions of Naturat Justice and consequently dircct the Respondent No.4 & 5 to consider the F-line Application vide No. D 8R02230O923855, dated L8-O4-2O23 and to conduct the Survey and demarcation in the land of the Petitioner to an extent of Ac.6-27 gts., in Sy.No.95/2, which is situated at Polepalle Ramnagar Village, Chinthapalle Mandal, Nalgonda District and to fix the boundanes to the Petitioner's land and pass such other order or orders as this Hon,ble court may deem fit and proper in the circumstances o[ the case in the interest of jr-lstice. "

It is stated that the petitioner is the owner and possessor of agriculture land admeasuring to an extent of Acs. 6.27 guntas in Survey No.95/2, situated at Polepalle Ramnagar Village, Chinthapalle Mandal, Nalgonda District (for short, 'the subject land), having succeeded the same from her husband late Sri Koppula Krishnaiah and the petitioner,s name was also mutated in [he revenue records and e-pattadar passbook and title deed was also issued in favour of the petitioner in respect of the subject land uid-e Passbook No.T28O50O2O338 and Khata No.5O9 under the provisions of the Telangana Rights in Land and Pattadar Passbooks Act, 2O2O. It is further stated that due to abnormal increase of the land price and in order to protect ) CVBR, J W.P.No.19371 of 2025 the subject land from land grabbers, the petitioner had submitted F-Line application uide No.DERO223OO92385S deited 1a.O4.2O23 to respondent Nos.4 and 5, by paying requisite fee t: conduct survey of the subject land and fix the boundaries. The grievance o{' the petitioner is that even after receiving the said F-Line application, tht: respondent authorities are not conducting survey and hxation of the boundaries.

3. Considered the submissions of the k:arned counsel for the petitioner and learned Assistant Government Pleader for Revenue appearing for the respondents and with their consent, this writ petition is disposed of at the admission stage.

4. learned counsel for the petitioner has submitted that in terms of the Circulars issued by the Commissioner, Survey. S,ettlements and Land Records, the respondcnts are bound to consider the rapplication within 45 days from the date of the application after collecting necessary charges.

Sri L.Ravinder, learned Assistant Government pleader for Revenue appearing lor the respondents has submifled that the respondent authorities will consider the aloresaid F-Line application submitted by the petitioner by following due procedure laid down uncler law and conduct survey and demarcate the subject land by fixing boun,laries.

It is settled law that the Survey Departmenl_ has the authority to conduct survey and demarcate lands in accordance with the provisions of the Telangana Land Revenue Act, 1317 Fasli (Act No. 'flll of 7377 Fasli), the 3 CVBR, J W.P.No. 19371 of 2025 Telangana Survey and Boundaries Act, 1923 and the Rules framed thereunder. The Government has issued various circulars specifying the conditions for conducting surveys, particularly F-Line (held measurement) . surveys. lndividuals requesting such surveys are required to submit specific I \ documents and if the conditions stipulated in the circuiars are fulhlled, the survey and boundary fixation may be conducted. The commissioner, Survey, Settlements ancl Land Records, exercising powers under the Telangana Survey and Boundaries Act, 1923, issued relevant Circulars from time to time uideRc.No.Nl/6543/99dated25.o7.2oo1,Rc.No.N1/l4o8l07dated t3.o7.2OO7 and Rc.No.N2lI74ll2olo dated 18.o5.2O10 stipulating the conditions for conducting survey of private lands and as per the said circulars, if the petitioner fulfils all the conditions of the said Circuiars, it is anobligationfortherespondentstoconductSurveywithinthetimespecified in the said Circulars. In view of the aforesaid discussion, this Court deems it appropriate to dispose ol this writ petition directing respondent Nos 3 and 4 to consider examine the petitioner's F-Line application uide No.DER0223O0923855 dated 18.04.2023, in accordance with the provisions of the Telangana Survey and Boundaries Act, 1923 arld also in terms ol the circular instructions issued by the commissioner, Survey, Settlements and Land Records for conclucting survey on held measurement applications (F-Line applications) from time to time, within a period of four (o4) weeks from the date of receipt of a copy of this order, if not already conducted' 4 CVBR,.
